The marks so placed shall not be interfered with, concealed, obliterated or erased by any person other than a 2 police officer or parking enforcement officer, while the same shall remain parked or standing at the place where so 3 marked. It shall constitute a parking violation to interfere with, conceal , obliterate or erase any mark in 4 violation of this section. 5 Section 6: Severability. 6 Should any section, subsection, paragraph, sentence, clause or phrase 7 of this ordinance or its application to any person or situation be declared 8 unconstitutional or invalid for any reason, such decision shall not affect 9 the validity of the remaining portions of this ordinance or its application 10 to any other person or situation. The City Council of the City of Everett 11 hereby declares that it would have adopted this ordinance and each section, 12 subsection, sentence, clause, phrase or portion thereof irrespective of the 13 fact that any one or more sections, subsections, sentences, clauses, phrases 14 or portions be declared invalid or unconstitutional . 15 Section 7: Third Party Liability. 16 It is expressly the purpose of this ordinance to provide for and 17 promote the health, safety and welfare of the general public and not to 18 create or otherwise establish or designate any particular class or group of 19 persons who will or should be especially protected or benefited by the terms 20 of this ordinance. 21 It is the specific intent of this ordinance that no provisions nor any 22 term used in this ordinance is intended to impose any duty whatsoever upon 23 the City or any of its officers or employees, for whom the implementation 24 and enforcement of this ordinance shall be discretionary and not mandatory. 25 Nothing contained in this ordinance is intended nor shall be construed 26 to create or form the basis of any liability on the part of the City, or its 27 officers, employees or agents, for any injury or damage resulting from any 28 29 30 31 32 4
