Section 204 of the Uniform Housing Code, 1988 Edition, is hereby <br /> amended by adding: <br /> Any person, firm or corporation violating any provision of this <br /> Code shall be deemed guilty of a misdemeanor and, upon conviction <br /> thereof, shall be punishable by a fine not to exceed one thousand <br /> dollars ($1,000) or by imprisonment in jail not to exceed ninety <br /> (90) days, or both fine and imprisonment. Each separate day or any <br /> portion thereof, during which any violation of this Code occurs or <br /> continues, shall be deemed to constitute a separate offense and, <br /> upon conviction thereof, shall be punishable as herein provided. <br /> The issuance of granting of a permit or approval of plans and <br /> specifications shall not be deemed or construed to be a permit for, <br /> or an approval of, any violation of any of the provisions of this <br /> Code. No permit presuming to give authority to violate or cancel <br /> the provisions of this Code shall be valid, except insofar as the <br /> work or use which it authorized is lawful. <br /> E. Chapter 3 of the Uniform Housing Code, 1988 Edition, is hereby <br /> amended by adding a new section which reads as follows: <br /> Inspection Fee <br /> Section 304. Any person, firm, company, governmental unit or corporation <br /> requesting a Housing Code compliance inspection by the City of Everett <br /> shall pay a fee of twenty-five dollars ($25) per living unit to a maximum <br /> of one thousand dollars ($1,000) . <br /> F. The Uniform Housing Code, 1988 Edition, is hereby amended by the <br /> addition of the following section: <br /> Authority to Abate <br /> a) Any violation of the Code is hereby declared to be a nuisance. <br /> b) Where a nuisance exists, the City Attorney on behalf of the City is <br /> authorized to institute injunction, mandamus, or other appropriate <br /> action or proceeding to prevent the violation of this Code. <br /> c) Notwithstanding paragraph (b) , the City Attorney is authorized to <br /> apply to any court of competent jurisdiction for and such court, <br /> upon hearing and for cause shown, may grant a temporary or <br /> permanent injunction restraining any person, firm and/or <br /> corporation from violating any provision of this Code and <br /> compelling compliance herewith. The cost of such action shall be <br /> taxes against the violator. <br /> d) A conviction of any person, firm or corporation for violating this <br /> Code shall not impede the authority granted in this section to the <br /> City Attorney or City. <br /> Section 3: The City Council hereby declares that should any section, <br /> paragraph, sentence or work of this ordinance or of the Uniform Housing Code <br /> hereby adopted be declared for any reason to be invalid, it is the intent of <br /> the City Council that it would have passed all portions of this ordinance and <br /> Code independent of the elimination herefrom of any such portion as may be <br /> declared invalid. <br /> - 3 <br />
