Section 204 of the Uniform Housing Code, 1988 Edition, is hereby amended by adding: Any person, firm or corporation violating any provision of this Code shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be punishable by a fine not to exceed one thousand dollars ($1,000) or by imprisonment in jail not to exceed ninety (90) days, or both fine and imprisonment. Each separate day or any portion thereof, during which any violation of this Code occurs or continues, shall be deemed to constitute a separate offense and, upon conviction thereof, shall be punishable as herein provided. The issuance of granting of a permit or approval of plans and specifications shall not be deemed or construed to be a permit for, or an approval of, any violation of any of the provisions of this Code. No permit presuming to give authority to violate or cancel the provisions of this Code shall be valid, except insofar as the work or use which it authorized is lawful. E. Chapter 3 of the Uniform Housing Code, 1988 Edition, is hereby amended by adding a new section which reads as follows: Inspection Fee Section 304. Any person, firm, company, governmental unit or corporation requesting a Housing Code compliance inspection by the City of Everett shall pay a fee of twenty-five dollars ($25) per living unit to a maximum of one thousand dollars ($1,000) . F. The Uniform Housing Code, 1988 Edition, is hereby amended by the addition of the following section: Authority to Abate a) Any violation of the Code is hereby declared to be a nuisance. b) Where a nuisance exists, the City Attorney on behalf of the City is authorized to institute injunction, mandamus, or other appropriate action or proceeding to prevent the violation of this Code. c) Notwithstanding paragraph (b) , the City Attorney is authorized to apply to any court of competent jurisdiction for and such court, upon hearing and for cause shown, may grant a temporary or permanent injunction restraining any person, firm and/or corporation from violating any provision of this Code and compelling compliance herewith. The cost of such action shall be taxes against the violator. d) A conviction of any person, firm or corporation for violating this Code shall not impede the authority granted in this section to the City Attorney or City. Section 3: The City Council hereby declares that should any section, paragraph, sentence or work of this ordinance or of the Uniform Housing Code hereby adopted be declared for any reason to be invalid, it is the intent of the City Council that it would have passed all portions of this ordinance and Code independent of the elimination herefrom of any such portion as may be declared invalid. - 3
