• <br /> • <br /> Notwithstanding any language used in this Code, it is not the intent of <br /> this Code to create a duty and/or cause of action running to any <br /> individual or identifiable person but rather any duty is intended to run <br /> only to the general public. <br /> B. Chapter 2, Section 201(a) of the Uniform Housing Code, 1988 <br /> Edition, is amended by deleting: <br /> Sec. 201(a) Authority. The building official is hereby authorized <br /> and directed to enforce all of the provisions of this code. For <br /> such purposes, he shall have the powers of a law enforcement <br /> officer. He is empowered to adopt and enforce rules and <br /> regulations to clarify and expand the provisions of this code in <br /> conformity with the spirit and intent of its stated purpose. <br /> and inserting in its place: <br /> Sec. 201(a) Authority. The building official and his designee are <br /> hereby authorized and directed to enforce all of the provisions of <br /> this code. For such purposes, they shall be empowered to adopt and <br /> enforce rules and regulations to clarify and expand the provisions <br /> of this code in conformity with the spirit and intent of its stated <br /> purpose. All references in this code to building official shall <br /> include the building official's designee. <br /> The building official or his disignee with the approval of the <br /> building official may appoint such number of technical officers and <br /> inspectors and other employees as shall be authorized from time to <br /> time. Such inspectors or employees may be deputized as may be <br /> necessary to carry out the functions of the code enforcement agency. <br /> C. Chapter 2, Section 203 of the Uniform Housing Code, 1988 Edition, <br /> is amended by deleting: <br /> Sec. 203. In order to provide for final interpretation of the <br /> provisions of this Code and to hear appeals provided for hereunder, <br /> there is hereby established a Housing Advisory and Appeals Board <br /> consisting of five members who are not employees of the City. The <br /> Building Official shall be an ex-officio member of and shall act as <br /> secretary of said Board. The Board shall be appointed by the <br /> governing body and shall hold office at its pleasure. The Board <br /> shall adopt reasonable rules and regulations for conducting its <br /> business and shall render all decisions and findings in writing to <br /> the appellant with a copy to the Building Official. Appeals to the <br /> Board shall be processed in accordance with the provisions <br /> contained in Section 1201 of this Code. Copies of all rules or <br /> regulations adopted by the Board shall be delivered to the Building <br /> Official, who shall make them freely accessible to the public. <br /> and inserting in its place: <br /> Sec. 203(a) General. In order to hear and decide appeals of <br /> orders, decisions or determinations made by the Building Official <br /> relative to the application and interpretation of this code, there <br /> shall be and is hereby created a Board of Appeals pursuant to <br /> Ordinance No. 351-75. Appeals from written orders of the Building <br /> Official must be filed within thirty calendar days from the date of <br /> receipt of the written order by the aggrieved party unless there is <br /> an order issued to vacate in which case the appeal shall be filed <br /> within ten days from the date of service of the order. The <br /> aggrieved party shall cause to be made at his own expense any tests <br /> or research required to substantiate his claim. <br /> - 2 <br />
