B. Section 203 of the 1988 Edition of the Uniform Mechanical Code is <br /> hereby amended by deleting: <br /> In order to hear and decide appeals of orders, decisions or <br /> determinations made by the Building Official relative to the application <br /> and interpretation of this code, there shall be and is hereby created a <br /> Board of Appeals consisting of members who are qualified by experience <br /> and training to pass upon matters pertaining to building construction and <br /> who are not employees of the jurisdiction. The Building Official shall <br /> be an ex officio member of and shall act as secretary to said Board but <br /> shall have no vote upon any matter before the Board. The Board of <br /> Appeals shall be appointed by the governing body and shall hold office at <br /> its pleasure. The Board shall adopt rules of procedure for conducting <br /> its business and shall render all decisions and findings in writing to <br /> the appellant with a duplicate copy to the Building Official. <br /> and inserting in its place: <br /> In order to hear and decide appeals of orders, decisions or <br /> determinations made by the Building Official relative to the application <br /> and interpretation of this code, there shall be and is hereby created a <br /> Board of Appeals pursuant to Ordinance No. 351-75. Appeals from written <br /> orders of the Building Official must be filed within thirty (30) calendar <br /> days from the date of receipt of the written order by the aggrieved <br /> party. The aggrieved party shall cause to be made at his own expense any <br /> tests or research required to substantiate his claim. <br /> C. Section 204 of the 1988 Edition of the Uniform Mechanical Code is <br /> hereby amended by the addition of the following: <br /> Any person, firm or corporation violating any of the provisions of this <br /> Code shall be deemed guilty of a misdemeanor and each such person shall <br /> be deemed guilty of a separate offense for each and every day or portion <br /> thereof during which any violation of any the provisions of this Code is <br /> committed, continued or permitted, and upon conviction of any such <br /> violation, such person shall be punishable by a fine of not more than <br /> $1,000 or by imprisonment for not more than 90 days or both such fine and <br /> imprisonment. <br /> D. Table No. 3-A Mechanical Permit Fees is amended to read: <br /> Table 3-A <br /> Mechanical Permit Fees <br /> 1. For the issuance of each permit $ 15.00 <br /> 2. Residential and Multi Family: <br /> For the purpose of mechanical fee calculations the definition of <br /> residential is new single family home, duplex, or individual <br /> dwellings within a new apartment building, condominium building, <br /> hotel, or motel which is individually heated and/or air <br /> conditioned. <br /> Conditioned floor space under 1,000 S.F $ 30.00 <br /> Conditioned floor space under 2,000 S.F. $ 60.00 <br /> Conditioned floor space 2,000 S.F. or more $ 80.00 <br /> - 2 - <br />
