3. Alteration and Commercial: <br /> The permit fee for the installation, replacement, relocation or <br /> repair of each non residential or multifamily heating, ventilation <br /> or air-conditioning unit or system, work performed on existing <br /> residential or multifamily systems or phased work on new systems <br /> is calculated according to the value of the work to be done as <br /> follows: <br /> $500 or less $ 15.00 <br /> $501 to $1,000 $ 30.00 <br /> Each additional $1,000 or fraction thereof over <br /> the first $1,000 $ 10.00 <br /> 4. Other Inspections and Fees: <br /> Inspections outside of normal business hours $30.00 per hour <br /> (minimum charge - two hours) <br /> Reinspection fees assessed under provisions of <br /> Section 305(f) $30.00 per hour <br /> Inspections for which no fee is specifically <br /> indicated (minimum charge - one-half hour) $30.00 per hour <br /> Additional plan review required by changes, <br /> additions or revisions to approved plans $30.00 per hour <br /> (minimum charge - one-half hour) <br /> E. The 1988 Edition of the Uniform Mechanical Code is hereby amended <br /> by the addition of the following: <br /> Authority to Abate. <br /> a) Any violation of the Code is hereby declared to be a nuisance. <br /> b) Where a nuisance exists, the City Attorney on behalf of the City <br /> is authorized to institute injunction, mandamus, or other <br /> appropriate action or proceeding to prevent the violation of this <br /> Code. <br /> c) Notwithstanding paragraph (b), the City Attorney is authorized to <br /> apply to any court of competent jurisdiction and such court, upon <br /> hearing and for cause shown, may grant a temporary or permanent <br /> injunction restraining any person, firm and/or corporation from <br /> violating any provision of this Code and compelling compliance <br /> herewith. The cost of such action shall be taxed against the <br /> violator. <br /> d) A conviction of any person, firm or corporation for violating this <br /> Code shall not impede the authority granted in this section to the <br /> City Attorney or City. <br /> Section 4: The City of Everett hereby declares that should any <br /> section, paragraph, sentence or word of this ordinance or of the Uniform <br /> Mechanical Code hereby adopted be declared for any reason to be invalid, it is <br /> the intent of the City of Everett that it would have passed all portions of <br /> this ordinance and the Code independent of the elimination herefrom of any <br /> such portion as may be declared invalid. <br /> - 3 - <br />
