• • • <br /> All exterior property and premises, and the interior of every structure, shall be free <br /> from accumulation of rubbish or garbage. <br /> 4. EMC 8.20.020 Nuisance, which reads: <br /> Except as authorized by subsection H of this section or as may be allowed by <br /> another city ordinance, no person owning, leasing, renting, occupying or having <br /> charge or possession of any property in the city, including vacant lots, shall maintain <br /> or allow to be maintained on the property outside of a fully enclosed structure such <br /> as a shed, dwelling, or closeable garage, any of the following conditions visible from <br /> any street, alley, or other public or private property: <br /> (A)Junk, trash, litter, boxes, discarded lumber or salvage materials or other similar <br /> materials. <br /> (C) Broken or discarded furniture, household equipment and furnishings; <br /> (E) Dead, decayed, diseased, noxious or hazardous trees or vegetation, or any <br /> vegetation (not including vegetation located in flower beds) taller than forty-two <br /> inches high or grass taller than twelve inches in height; <br /> 5. IRC R105.1 Permit required, which reads: <br /> Any owner or authorized agent who intends to construct, enlarge, alter, repair, <br /> move, demolish or change the occupancy of a building or structure, or to erect, <br /> install, enlarge, alter, repair, remove, convert or replace any electrical, gas, <br /> mechanical or plumbing system, the installation of which is regulated by this code, <br /> or cause any such work to be done, shall first make application to the building <br /> official and obtain the required permit. <br /> Conclusions of Law Based on Above Findings: <br /> 1. Construction activity conducted on property within the City of Everett without <br /> required City permits is a violation of IRC R105.1. The record shows the <br /> Respondent violated said City ordinance. <br /> 2. Unpermitted construction work conducted on the residential structure and attached <br /> garage on the property is unlawful as defined by IPMC 108.1.4 and is a violation of <br /> IPMC 106.1. The record shows the Respondent violated said City ordinance. <br /> 3. Discarded construction debris, buckets, junk, litter and a mattress on the property in <br /> public view are violations of EMC 8.20.020(A)(C) and a public nuisance. The record <br /> shows the Respondent violated said City ordinances. <br /> 4. Piles of dead vegetation on the property are violations of EMC 8.20.020(E) and a <br /> public nuisance. The record shows the Respondent violated said City ordinance. <br />
