s 5. Uncontained junk and litter on the property is a violation of IPMC 308.1. The record shows the Respondent violated said City ordinance. ORDER Based on the Findings of Fact and Conclusions of Law as stated above, it is hereby determined that the Respondent was in violation of IPMC 106.1, IPMC 308.1, IRC R105.1 and EMC 8.20.020(A)(C)(E) and is hereby ordered to: 1. The Respondent must abate all violations of IPMC 106.1, IPMC 308.1, IRC R105.1 and EMC 8.20.020(A)(C)(E) on property located at 9430 Holly Drive, Everett, Washington. 2. All abatement of the violations on said property must be completed by June 22, 2017. The abatement shall include: a. The Respondent shall maintain the property according to City ordinances. b. The Respondent shall maintain the property free of nuisances including discarded construction debris, buckets, junk, litter, dead vegetation and a mattress. Approved garbage containers with tight fitting lids shall be used to store garbage and refuse on the property. c. The Respondent shall apply for and obtain all of the necessary and required permits to bring the property into compliance with City ordinances. Upon receipt of the building permits the Respondent shall conduct and complete all of the required work and have the work inspected and approved by the City of Everett Building Division within 180 days from the date of the hearing or by June 22, 2017. Any violations not listed in this Order are subject to standard enforcement processes and procedures. 3. The Respondent shall be fined $500.00 for each violation of IPMC 106.1, IPMC 308.1, IRC R105.1 and EMC 8.20.020(A)(C)(E) for a total fine of$2000.00. $1500.00 of the fine shall be suspended provided the Respondent comply with items 2a-2c of this Order by the date indicated. If compliance is not met then the suspended fine shall be due to the City immediately. 4. The Respondent shall not violate any ordinance set forth in EMC §1.20.020 or any ordinance or regulation that identifies the enforcement procedure described in Chapter 1.20 EMC as the enforcement procedure for said regulations or ordinance, for the next twenty-four (24) months. 5. The Respondent shall pay the $500.00 fine no later than January 6, 2017. Payment shall be made to the City of Everett Treasurer at 2930 Wetmore Suite 100, Everett Washington, 98201. If payment is not made on or before January 6, 2017, collection action will be taken, which may include assigning the debt to a collection agency pursuant to EMC §1.20.050(D).
