s <br /> 5. Uncontained junk and litter on the property is a violation of IPMC 308.1. The record <br /> shows the Respondent violated said City ordinance. <br /> ORDER <br /> Based on the Findings of Fact and Conclusions of Law as stated above, it is hereby <br /> determined that the Respondent was in violation of IPMC 106.1, IPMC 308.1, IRC <br /> R105.1 and EMC 8.20.020(A)(C)(E) and is hereby ordered to: <br /> 1. The Respondent must abate all violations of IPMC 106.1, IPMC 308.1, IRC R105.1 <br /> and EMC 8.20.020(A)(C)(E) on property located at 9430 Holly Drive, Everett, <br /> Washington. <br /> 2. All abatement of the violations on said property must be completed by June 22, <br /> 2017. The abatement shall include: <br /> a. The Respondent shall maintain the property according to City ordinances. <br /> b. The Respondent shall maintain the property free of nuisances including <br /> discarded construction debris, buckets, junk, litter, dead vegetation and a <br /> mattress. Approved garbage containers with tight fitting lids shall be used to <br /> store garbage and refuse on the property. <br /> c. The Respondent shall apply for and obtain all of the necessary and required <br /> permits to bring the property into compliance with City ordinances. Upon receipt <br /> of the building permits the Respondent shall conduct and complete all of the <br /> required work and have the work inspected and approved by the City of Everett <br /> Building Division within 180 days from the date of the hearing or by June 22, <br /> 2017. Any violations not listed in this Order are subject to standard enforcement <br /> processes and procedures. <br /> 3. The Respondent shall be fined $500.00 for each violation of IPMC 106.1, IPMC <br /> 308.1, IRC R105.1 and EMC 8.20.020(A)(C)(E) for a total fine of$2000.00. <br /> $1500.00 of the fine shall be suspended provided the Respondent comply with <br /> items 2a-2c of this Order by the date indicated. If compliance is not met then the <br /> suspended fine shall be due to the City immediately. <br /> 4. The Respondent shall not violate any ordinance set forth in EMC §1.20.020 or any <br /> ordinance or regulation that identifies the enforcement procedure described in <br /> Chapter 1.20 EMC as the enforcement procedure for said regulations or ordinance, <br /> for the next twenty-four (24) months. <br /> 5. The Respondent shall pay the $500.00 fine no later than January 6, 2017. <br /> Payment shall be made to the City of Everett Treasurer at 2930 Wetmore Suite 100, <br /> Everett Washington, 98201. If payment is not made on or before January 6, 2017, <br /> collection action will be taken, which may include assigning the debt to a collection <br /> agency pursuant to EMC §1.20.050(D). <br />
