Cell Site No.WA-808-01 <br /> Cell Site Name:Everett Golf&Country Club <br /> Fixed Asset No.10033054 <br /> Market:SEATTLE/OREGON/NO.ID <br /> Address:6107 Berkshire Drive,Everett,WA 98203 <br /> WHEREAS, Lessor and Lessee desire to amend the Lease on the terms and conditions <br /> contained herein. <br /> NOW THEREFORE, for good and valuable consideration, the receipt and sufficiency of <br /> which are acknowledged, Lessor and Lessee agree as follows: <br /> 1. Recitals; Defined Terms. The parties acknowledge the accuracy of the foregoing <br /> recitals. Any capitalized terms not defined herein shall have the meanings ascribed to them in <br /> the Lease. <br /> 2. Section 2 TERM: of the Lease is hereby deleted in its entirety and the following <br /> is inserted in its place: <br /> The Initial Term of the Lease shall be for five (5) years commencing on April 1, <br /> 2003 and ending on March 31, 2008, unless otherwise terminated as provided <br /> below. As provided in Section 5 OPTION TO EXTEND, Lessee is entitled to <br /> extend the Lease Term. <br /> 3. Section 3 USE: Paragraph iv of the Lease is hereby deleted in its entirety and the <br /> following is inserted in its place: <br /> During the Lease Term, Lessee's authorized employees, representatives, tenants, <br /> licensees, invitees, contractors or agents shall have 24-hours-a-day, 7-days-a- <br /> week access to the Site, including the right to nonexclusive use of the existing <br /> access from Highway Place located over, across and upon Lessor's real property <br /> adjoining the Site for the purpose of ingress to and egress from the Site, however <br /> control of the keys to said access must be tightly maintained. Lessor reserves the <br /> right to access the Site for the purpose of inspection and operating, maintaining <br /> and servicing its property, improvements and equipment. <br /> Lessee agrees to provide the Lessor seventy-two (72) hours' notice prior to <br /> accessing the Site, except in the case of an emergency. In the event of an <br /> emergency, as described by Lessee, where Lessee cannot reasonably provide <br /> advance notice of required access, Lessee shall call 24 Hr. Access Notification <br /> Phone Number 425-257-8832 prior to accessing the Site and within twenty-four <br /> (24) hours following actual notice of emergency access, inform Lessor of the <br /> following: (i) the date and time of emergency access and (ii) the nature of the <br /> event requiring such emergency access. <br /> Site Names: 2 <br /> Reservoir 3 Site;Everett Water Tank <br />
