Cell Site No.WA-808-01 <br /> Cell Site Name:Everett Golf&Country Club <br /> Fixed Asset No.10033054 <br /> Market:SEATTLE/OREGON/NO.ID <br /> Address:6107 Berkshire Drive,Everett,WA 98203 <br /> Lessee must provide for separately metered utility services at the Site. Subject to <br /> Third Party's approval of antenna placement as previously granted upon <br /> commencement of the Lease, and subject to obtaining Lessor's approval, which <br /> shall not be unreasonably withheld or delayed, and all required permits, Lessee <br /> can: <br /> a.Transmit and receive radio signals on various frequencies; <br /> b. Furnish, install and use in, upon and under and remove from the Site <br /> such wires, equipment and other property of whatsoever kind and <br /> nature as Lessee deems necessary; <br /> c.Connect such wires and equipment to utility lines adjoining the Site; <br /> and <br /> d. Install standby generators for Lessee's exclusive use at locations at the Site <br /> acceptable to both parties. <br /> 4. A new Paragraph viii is added to Section 3 USE as follows: <br /> In the event of any federal, state or local directive beyond Lessee's control, <br /> Lessee, may use the Site, at no additional charge by Lessor, in order to modify, <br /> supplement, replace, upgrade, expand, including but not limited to the number <br /> and type(s) of antennas, or refurbish the equipment and/or improvements thereon, <br /> and to reconfigure the same within the Site in order to be in compliance with any <br /> such directive by federal, state or local mandate, including but not limited to <br /> emergency 911 communication services. Lessor shall reasonably cooperate in <br /> obtaining governmental and other use permits or approvals necessary to comply <br /> with such mandate. If Lessor does not comply with the terms of this Section, in <br /> addition to any other rights it may have at law, Lessee may terminate the Lease <br /> and shall have no further liability to Lessor. <br /> 5. Section 4 RENT, paragraphs i. and ii. of the Lease, are hereby amended <br /> as follows: <br /> i. The Lessee shall pay a Rental Fee to the Lessor at a monthly rate of <br /> Four Thousand One Hundred Fifty-Seven and 85/100 Dollars ($4,157.85) per <br /> month. <br /> ii. Said Rental Fee shall increase on April 1, 2019, and each April 1st of <br /> each subsequent year of the term thereof by an amount equal to four percent (4%) <br /> of the Rental Fee in effect for the previous year. <br /> 6. Section 5. OPTION TO EXTEND: Paragraph one of Section 5 of the <br /> Lease is hereby amended and the following is inserted in its place: <br /> Site Names: 3 <br /> Reservoir 3 Site;Everett Water Tank <br />
