EXHIBIT #2 <br /> Q E <br /> CONCOMITANT AGREEMENT TO REZONE ORDINANCE NO./��� O 7 <br /> SEAWAY CENTER, DEVELOPMENT RESERVE AREA, LOT #6 <br /> THIS AGREEMENT is made and entered this 12th day of may, 1989, by <br /> Washington Services, Inc., said party being hereinafter referred to as <br /> "Owner", and the City of Everett, a municipal corporation under the laws of <br /> the State of Washington, hereinafter referred to as the "City"; <br /> WITNESSETH: <br /> WHEREAS, the Owner is the owner of a tract of real property <br /> approximately twenty (20) acres in size located north of Merrill Creek <br /> Parkway, and east of Merrill and Ring Creek, the legal description of which <br /> is attached hereto as Exhibit "A" and incorporated herein by reference; and <br /> WHEREAS, the rezoning designation authorized by Ordinance No. 1580-89 <br /> and development of the property described in Exhibit "A" in accordance with <br /> the requirements of this Agreement will allow uses which are more compatible <br /> with the industrial park designated property to the west and with planned <br /> residential development to the north and east; and <br /> WHEREAS, the public health, safety, and welfare would be best served <br /> by anticipating the impact of such development and imposing certain mutually <br /> agreed upon standards, conditions and requirements as set forth herein and <br /> hereafter considered to be an integral part of the zoning restrictions <br /> applicable to said property; and <br /> WHEREAS, the Owner has agreed to develop the aformentioned property <br /> as in accordance with the requirements of this Agreement in consideration of <br /> the City considering designating the property C-2 Heavy Commercial-Light <br /> 1 Industrial and the Owner further agrees as part of said consideration that <br /> should the City zone the property C-2 Heavy Commercial-Light Industrial, to <br /> lay out, develop and maintain the property as hereinafter set forth; <br /> NOW THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS: <br /> 1. Any development of this property shall be subject to the Seaway <br /> Center Master Site Plan # 9-87 and Preliminary Binding Site Plan <br /> #1-87 or as amended. Specific requests for Building Permits will <br /> require a detailed site plan review by the Planning Department. <br />
