That in the event that the proposed project is not developed in <br /> accordance with the expressed intent of the proposal and the site <br /> plan submitted and reviewed by the Planning Commission, due to <br /> unforeseen circumstances, the Planning Commission reserves the right <br /> to reconsider both the Comprehensive Plan designation and the <br /> rezoning of the subject properties. <br /> 5. That at such time that the rezone ordinance and final plat map are <br /> recorded, a true and correct legal description for the proposed <br /> project site including the subject properties being rezoned from R-1 <br /> to R-3(A) shall be submitted to and must be approved by the Planning <br /> Director. <br /> The Planning Commission bases this recommendation upon the following <br /> findings: <br /> 1. The proposed General Plan amendment and rezone are for the purpose of <br /> constructing a 120-bed, 50,000 square foot skilled nursing home <br /> facility, which will be compatible with the prevailing neighborhood <br /> residential character in the proposed project's vicinity. <br /> 2. The existing General Plan density designations will allow single <br /> family residence with a maximum density of 10 dwelling units per <br /> gross acre, while the proposed amendment of the General Plan Land Use <br /> Map and Zoning Map would allow Multiple Family Residential with <br /> maximum density of 25 dwelling units per gross acre and will also <br /> result in an integrated zone for the proposed skilled nursing home <br /> facility. <br /> 3.
