Section 1: That the following described right-of-way; <br /> Thirteenth Street lying west of Grand Avenue between Lots 1 and <br /> 32, Block 225, Supplemental Plat of Church and LaMoure's Addition <br /> to Everett, as recorded in Volume 3 of Plats, page 35, records of <br /> Snohomish County, and, Lot 1, Block 242, Plat of Everett, Division <br /> "R" as per Plat recorded in Volume 6 of Plats on page 33, records <br /> of Snohomish County, State of Washington. <br /> Be and the same is hereby vacated pursuant to the following conditions: <br /> A: That the City of Everett shall not be responsible nor liable for <br /> storm drainage runoff resulting from existing drainage patterns as <br /> established on City rights-of-way that may currently, or in the <br /> future, go over, under or across the property described in Section <br /> 1 herein. <br /> B: That the City of Everett shall not be responsible nor liable for <br /> any sloughing, slipping or sliding of the existing bank/bluff and <br /> any damage caused thereby to abutting and adjacent properties and <br /> the property described in Section 1 herein. <br /> C: That the City of Everett hereby retains an easement for the <br /> preservation of a view corridor and to construct, reconstruct, <br /> operate, maintain, repair and replace all utilities under, over <br /> and across the following easement: <br /> An easement being 7.5 feet on each side of the following described <br /> centerline lying within the property as described in Section 1 <br /> herein: <br /> - 2 - <br /> II <br />
