r <br /> Commencing at the southeast corner of Lot 1, Block 225 of <br /> Supplemental Plat of Church and LaMoure's Addition to Everett <br /> according to the plat thereof recorded in Volume 3 of Plats, page <br /> 35, records of Snohomish County, Washington; thence south along <br /> the southerly extension of said Lot 1 a distance of 40 feet to the <br /> True Point of Beginning; thence westerly parallel to the south <br /> line of said Lot 1 and Lot 32 of said Block 225 and also being <br /> parallel to the north line of Lot 1, Block 242, Plat of Everett <br /> Division "R" according to the plat thereof recorded in Volume 6 of <br /> Plats, page 33, records of Snohomish County, Washington to the <br /> westerly line of said plats and the termination of this <br /> description. <br /> D: That at all times all activities conducted in and around the <br /> herein described easement shall be conducted so as not to <br /> interefere with, obstruct or endanger the City's use of the <br /> easement. <br /> E: That prior to any construction, work or any other activity being <br /> conducted in or on the herein easement by anyone other than the <br /> City, notification and plans for the same shall be submitted in <br /> writing to the City and no such construction, work or activity <br /> shall be commenced without the City's prior written agreement that <br /> the proposed construction, work or activity will not interfere <br /> with City's easement described herein; PROVIDED, HOWEVER, any <br /> changes or revisions in the plans shall also be subject to City's <br /> prior review and agreement. The City's review of the plans under <br /> this easement shall not be deemed to impose any duty or obligation <br /> on the City to determine the adequacy or sufficiency of the plans <br /> and designs nor determine whether said construction, work or <br /> activity is in conformance with other applicable plans, codes and <br /> - 3 - <br />
