1 ORDINANCE NO./�/p 7 <br /> 2 <br /> 3 AN ORDINANCE relating to prostitution, adding new sections to <br /> Chapter 10.24 of the Everett Municipal Code (Ordinance No. <br /> 4 1145-85) . <br /> 5 <br /> 6 THE CITY OF EVERETT DOES ORDAIN: <br /> 7 Section 1 : Prostitution - Sex of Parties Immaterial - No Defense. In <br /> any prosecution for prostitution, the sex of the two parties or prospective <br /> 8 parties to the sexual conduct engaged in, contemplated, or solicited is <br /> 9 immaterial , and it is no defense that: (1 ) such persons were of the same <br /> 10 sex; or (2) the person who received, agreed to receive, or solicited a fee <br /> was a male and the person who paid or agreed or offered to pay such fee was <br /> 11 female. <br /> 12 Section 2: Permitting Prostitution. <br /> 13 1 . A person is guilty of permitting prostitution if, having <br /> possession or control of premises which he or she knows are being used for <br /> 14 prostitution purposes, he or she fails without lawful excuse to make <br /> 15 reasonable effort to halt or abate such use. <br /> 16 2. Permitting prostitution is a misdemeanor. <br /> Section 3: Patronizing a Prostitute. <br /> 17 <br /> 18 1 . A person is guilty of patronizing a prostitute if: <br /> 19 (a) pursuant to a prior understanding, he or she pays a <br /> fee to another person as compensation for such person <br /> 20 or a third person having engaged in sexual conduct <br /> with him or her; or <br /> 21 (b) he or she pays or agrees to pay a fee to another <br /> 22 person pursuant to an understanding that in return <br /> therefor such person will engage in sexual conduct <br /> 23 with him or her; or <br /> 24 (c) he or she solicits or requests another person to <br /> engage in sexual conduct with him or her in return <br /> 25 for a fee. <br /> 26 2. Patronizing a prostitute is a misdemeanor. <br /> 27 Section 4: Sections 1 , 2 and 3 hereof shall be codified as additional <br /> 28 new sections to Chapter 10.24 of the Everett Municipal Code. <br /> 29 Section 5: SEVERABILITY. <br /> 30 Should any section, subsection, paragraph, sentence, clause or phrase <br /> 31 of this ordinance or its application to any person or situation be declared <br /> 32 <br />
