The City Council of the City of Everett <br /> 4 hereby declares that it would have adopted this ordinance and each section, <br /> 5 subsection, sentence, clause, phrase or portion thereof irrespective of the <br /> 6 fact that any one or more sections, subsections, sentences, clauses, phrases <br /> 7 or portions be declared invalid or unconstitutional . <br /> 8 Section 6: THIRD PARTY LIABILITY. <br /> 9 It is expressly the purpose of this Chapter to provide for and promote <br /> 10 the health, safety and welfare of the general public and not to create or <br /> 11 otherwise establish or designate any particular class or group of persons <br /> 12 who will or should be especially protected or benefited by the terms of this <br /> 13 Chapter. <br /> 14 It is the specific intent of this Chapter that no provisions nor any <br /> 15 term used in this Chapter is intended to impose any duty whatsoever upon the <br /> 16 City or any of its officers or employees, for whom the implementation and <br /> 17 enforcement of this Chapter shall be discretionary and not mandatory. <br /> 18 Nothing contained in this Chapter is intended nor shall be construed to <br /> 19 create or form the basis of any liability on the part of the City, or its <br /> 20 officers, employees or agents, for any injury or damage resulting from any <br /> 21 action or inaction on the part of the City related in any manner to the <br /> 22 enforcement of this Chapter by its officers, employees or agents. <br /> 23 77- <br /> 24 <br /> WILLIAM E.
