1 ORDINANCE NO. 45-66::g5? <br /> 2 <br /> 3 AN ORDINANCE regulating the sale of tobacco products and <br /> amending Ordinance No. 295-74 by the addition of a new <br /> 4 chapter. <br /> 5 <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> 6 <br /> 7 Ordinance No. 295-74 is hereby amended by the addition of a new chapter <br /> 8 regulating the sale of tobacco products which chapter shall read as follows: <br /> 9 Section 1 : Legislative Intent. <br /> 10 The City Council finds that the use of tobacco products, and in <br /> 11 particular cigarette smoking by minors, is a continuing problem with grave <br /> 12 social consequences. In recognition of the Surgeon General 's recent report <br /> 13 finding cigarette smoking is as addictive as cocaine and heroin, it is the <br /> 14 consensus of the medical and public health community and the Surgeon General <br /> 15 of the United States that the use of tobacco, especially in the form of <br /> 16 cigarette smoking, is a public health problem of the highest priority, <br /> 17 resulting in the premature death of more than 300,000 persons annually in <br /> 18 this nation through cancer, health disease and other causes. It is <br /> 19 Ymperative to take more vigorous enforcement action to implement the <br /> 20 existing prohibition of sales to minors. We seek to act now to avoid public <br /> 21 and private cost of future health care for youths who develop the habit of <br /> 22 smoking in adolescence. Tobacco products, and especially cigarettes, are <br /> 23 often available to persons under the age of eighteen (18) . The City Council <br /> 24 further finds that decades of experience with the present system of <br /> 25 prohibiting sales of tobacco products to minors has proven significantly <br /> 26 defective. The City Council seeks to develop a strict, comprehensive, <br /> 27 effective and enforceable system to control the sale of tobacco products to <br /> 28 minors. <br /> 29 Section 2: Definitions. <br /> 30 2.1 "Retailer" means any person, firm, association, company, <br /> 31 partnership or corporation who operates a store, stand, booth, concession or <br /> 12 <br />
