. <br /> • <br /> other place at which sales are made to purchasers for consumption or use of <br /> 2 tobacco products. <br /> 3 2.2 "Tobacco vending machine" means and includes any machine or <br /> 4 device designated for or used for the vending of cigarettes, cigars, tobacco <br /> 5 or tobacco products upon the insertion of coins, trade checks or slugs. <br /> 6 2.3 "Tobacco vending machine distributor" means any person who leases <br /> 7 to or places with others any tobacco vending machine. <br /> 8 2.4 "Tobacco vending machine operator" means any person who operates, <br /> g rents or possesses one or more tobacco vending machine. <br /> 10 2.5 "The licensing authority" means the City Clerk or his/her <br /> 11 designee. <br /> 12 2.6 "Minor" means an individual who is less than eighteen (18) years <br /> 13 of age. <br /> 14 2.7 "Sales conducted in person" means payment for the purchase of the <br /> 15 tobacco item is received directly and in person from the purchaser by the <br /> 16 seller or his employee. Tobacco vending machines which are located in plain <br /> 17 view of the seller or his employee and controlled by an electronic device <br /> 18 activated by the seller or his employee, upon the buyer's presentation of <br /> 19 acceptable identification as required in Section 4, shall be deemed "sales <br /> 20 conducted in person. " <br /> 21 Section 3: Tobacco Vending Machines. <br /> 22 3.1 No person shall distribute, operate, lease, sell , rent or possess <br /> 23 any tobacco vending machine without first securing and maintaining a <br /> 24 distributor's or operator's license as required by this chapter. <br /> 25 3.2 Each distributor' s or operator's license shall specify the number <br /> 26 of machines at the location. It shall be a violation of this chapter to <br /> 27 increase or decrease the number of tobacco vending machines at a location <br /> 28 without notifying the licensing authority and securing a revised license. <br /> 29 3.3 All tobacco vending machines shall have the name and address of <br /> 30 the distributor and owner indelibly printed, painted or impressed upon it. <br /> 31 It shall be unlawful for any tobacco vending machine distributor or tobacco <br /> i2 <br /> 2 <br />
