• <br /> 1 personnel and/or agents or other public officials alleging facts exist which <br /> 2 constitute grounds for suspension or revocation of a license. The licensing <br /> 3 authority may also rely on facts and circumstances otherwise brought to its <br /> 4 attention in determining whether or not to suspend or revoke a license. <br /> 5 Section 20: Appeals Procedure. <br /> 6 Any licensee who has had a license suspended or revoked under this <br /> 7 regulation may appeal the suspension or revocation in writing by filing with <br /> 8 the licensing authority, within seven (7) calendar days of the date of the <br /> 9 notification of suspension, a notice of appeal . Thereafter, the City <br /> 10 Council shall hold a hearing on such suspension. The decision of the City <br /> 11 Council shall be final and conclusive. Proceedings to review such decision <br /> 12 of the City council must be instituted within fifteen (15) days of final <br /> 13 action by City Council . <br /> 14 Section 21 : Death or Incapacity of Licensee. <br /> 15 1 In the event of the incapacity, death, receivership, bankruptcy, or <br /> 16 assignment for benefit of creditors of any licensee, then his guardian, <br /> 17 executor, administrator, receiver, trustee in bankruptcy or assignee for <br /> 18 benefit of creditors may, upon written authority from the licensing <br /> 19 authority, continue the business of the licensee on the premises for the <br /> 20 duration of the license, unless sooner terminated. Any such successor <br /> 21 wishing to continue the license shall provide information as requested by <br /> 22 the licensing authority. <br /> 23 Section 22: Civil Penalty. <br /> 24 In addition to or as an alternative to any other penalty provided <br /> 25 herein or by law, any licensee who fails to comply with any provisions of <br /> 26 this chapter or any person who engages in any activity for which a license <br /> 27 is required pursuant to the provisions of this chapter while his or her <br /> 28 license is suspended or revoked, or who fails to obtain a license prior to <br /> 29 engaging in the activity for which a license is required, shall pay a civil <br /> :10 penalty of One Hundred Dollars ($100) per day for the first violation or <br /> it Five Hundred Dollars ($500) per day for the second violation and One <br /> V.2 <br /> 11 <br />
