The civil <br /> 3 penalty may be assessed and collected by use of all appropriate legal <br /> 4 remedies. <br /> 5 Section 23: Public Nuisance. <br /> 6 Any activity, act or conduct undertaken without a license required by <br /> 7 this chapter constitutes a public nuisance and such activity, act or conduct <br /> 8 may be abated by the licensing authority or law enforcement personnel by <br /> 9 securing an appropriate order from the court. <br /> 10 Section 24: Applicability of Amendments. <br /> 11 All applications filed after the effective date of this chapter shall <br /> 12 be processed in accordance with the terms of this chapter. <br /> 13 Section 25: Severability. <br /> 14 Should any section, subsection, paragraph, sentence, clause or phrase <br /> 15 of this chapter be declared unconstitutional or invalid for any reason, such <br /> 16 decision shall not affect the validity of the remaining portions of such <br /> 17 chapter. <br /> 18 Section 26: Conflict. <br /> 19 Should there be a conflict between any of the provisions set forth in <br /> 20 this chapter and the General Provisions found in Chapter 5.04 of the Everett <br /> 21 Municipal Code, the provisions set forth in this chapter shall control . <br /> 22 Section 27: City Non-Liability. <br /> 23 27.1 It is expressly the purpose of this chapter to provide for and <br /> 24 promote the health, safety and welfare of the general public, and not to <br /> 25 create or otherwise establish or designate any particular class or group of <br /> 26 persons who will or should be especially protected or benefited by the terms <br /> 27 of this chapter. <br /> 28 27.2 It is the specific intent of this chapter that no provision nor <br /> 99 term used in this ordinance is intended to impose any duty whatsoever upon <br /> 30 the City or any of its officers or employees, for whom the implementation or <br /> 31 enforcement of this chapter shall be discretionary and not mandatory. <br /> t2 <br /> 12 <br />
