The civil 3 penalty may be assessed and collected by use of all appropriate legal 4 remedies. 5 Section 23: Public Nuisance. 6 Any activity, act or conduct undertaken without a license required by 7 this chapter constitutes a public nuisance and such activity, act or conduct 8 may be abated by the licensing authority or law enforcement personnel by 9 securing an appropriate order from the court. 10 Section 24: Applicability of Amendments. 11 All applications filed after the effective date of this chapter shall 12 be processed in accordance with the terms of this chapter. 13 Section 25: Severability. 14 Should any section, subsection, paragraph, sentence, clause or phrase 15 of this chapter be declared unconstitutional or invalid for any reason, such 16 decision shall not affect the validity of the remaining portions of such 17 chapter. 18 Section 26: Conflict. 19 Should there be a conflict between any of the provisions set forth in 20 this chapter and the General Provisions found in Chapter 5.04 of the Everett 21 Municipal Code, the provisions set forth in this chapter shall control . 22 Section 27: City Non-Liability. 23 27.1 It is expressly the purpose of this chapter to provide for and 24 promote the health, safety and welfare of the general public, and not to 25 create or otherwise establish or designate any particular class or group of 26 persons who will or should be especially protected or benefited by the terms 27 of this chapter. 28 27.2 It is the specific intent of this chapter that no provision nor 99 term used in this ordinance is intended to impose any duty whatsoever upon 30 the City or any of its officers or employees, for whom the implementation or 31 enforcement of this chapter shall be discretionary and not mandatory. t2 12
