1 vending machine operator to possess any tobacco vending machine not so 2 identified. 3 3.4 It is unlawful to install , place or permit the use of any tobacco 4 vending machine in any establishment or portion thereof which is open to 5 minors, except in a place therein where the machine is not accessible to or 6 cannot be used by minors; PROVIDED, tobacco vending machines may be 7 installed in establishments or portions thereof to which access by minors is 8 prohibited by law, and in commercial buildings or industrial plants or 9 portions thereof where the public is not usually admitted and where such 10 machines are for the use of employees therein. 11 Section 4: Requirement for Production of Identification. 12 No retailer or employee of a retailer shall sell or permit to be sold, 13 by vending machine or otherwise, cigarettes or other tobacco products to any 14 individual suspected of being a minor. If the retailer or the retailer's 15 employee suspects that a minor is attempting to purchase a tobacco item, the 16 retailer or retailer's employee is required to request and examine 17 identification from the purchaser and positively establish the purchaser' s 18 age as eighteen years or greater before allowing the purchase of the tobacco 19 item to occur. 20 Section 5: Posting of Tobacco Products Required. 21 No retailer shall sell or permit to be sold, cigarettes or other 22 tobacco products, unless the tobacco vending machine or other location at 23 which the cigarettes or other tobacco products are available for purchase is 24 posted with a notice which is clearly visible to anyone purchasing the 25 products, and which states: 26 IT IS ILLEGAL TO SELL OR PERMIT TO BE SOLD 27 ANY TOBACCO PRODUCTS TO ANY PERSON UNDER THE AGE OF EIGHTEEN (18) - RCW 26.28.080 28 29 30 31 32 3
