• <br /> 1 deemed guilty of a misdemeanor punishable by a fine not more than One <br /> 2 Thousand Dollars ($1 ,000) . <br /> 3 b. Each person, firm or corporation shall be guilty of a separate <br /> 4 offense for each and every day during any portion of which any violation of <br /> 5 any provision of this Ordinance is committed, continued or permitted by such <br /> 6 person and shall be punishable accordingly. <br /> 7 Section 7: REPEALER. <br /> 8 Ordinance No. ' s 1720 and 4058 (EMC 8.20) and all ordinances in conflict <br /> 9 herewith are hereby repealed. <br /> 10 Section 8: THIRD PARTY LIABILITY. <br /> 11 It is expressly the purpose of this ordinance to provide for and <br /> 12 promote the health, safety and welfare of the general public, and not to <br /> 13 create or otherwise establish or designate any particular class or group of <br /> 14 persons who will or should be especially protected or benefited by the terms <br /> 15 of this ordinance. <br /> 16 It is the specific intent of this ordinance to place the obligation of <br /> 17 complying with its requirements upon the property owner(s) and no provisions <br /> 18 nor term used in this ordinance is intended to impose any duty whatsoever <br /> 19 upon the City or any of its officers and employees, for whom the <br /> 20 implementation or enforcement of this ordinance shall be discretionary and <br /> 21 not mandatory. <br /> 22 Nothing contained in this ordinance is intended to be nor shall be <br /> 23 construed to create or form the basis for any liability on the part of the <br /> 24 City, or its officers, employees or agents, for any injury or damage <br /> 25 resulting from the failure of a property to comply with the provisions of <br /> 26 this ordinance, or by reason or in consequence of any inspection, notice, <br /> 27 order, certificate, permission or approval authorized or issued or done in <br /> 28 connection with the implementation or enforcement of this ordinance, or by <br /> 29 reason of any action or inaction on the part of the City related in any <br /> 30 manner to the enforcement of this ordinance by its officers, employees or <br /> 31 agents. <br /> 32 <br /> 8 <br />
