• <br /> 1 ORDINANCE NO. / ! .-fl' <br /> 2 <br /> 3 AN ORDINANCE amending Ordinance No. 1O6g-84 to provide for an <br /> administrative hearing for persons whose vehicles have been <br /> 4 impounded. <br /> 5 <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> 6 <br /> 7 Section 1 : Section 1 of Ordinance No. 993-83 (EMC 46.10.010) which <br /> 8 reads as follows: <br /> 9 <br /> Officers authorized to remove certain vehicles. <br /> 10 <br /> Any police officer may take custody of a vehicle and provide for <br /> 11 its prompt removal to a place of safety under any of the <br /> following circumstances: <br /> 12 <br /> 1 . Whenever any police officer finds a vehicle standing upon <br /> 13 the roadway in violation of any of the provisions of RCW <br /> 46.61 .560, the officer is hereby authorized to provide for <br /> 14 the removal of the vehicle or require the driver or other <br /> person in charge of the vehicle to move the vehicle to a <br /> 15 position off the roadway. <br /> 16 2. Whenever any police officer finds a vehicle unattended upon <br /> any highway where the vehicle constitutes an obstruction to <br /> 17 traffic or jeopardizes public safety. <br /> 18 3. Whenever a police officer finds an unattended vehicle at <br /> the scene of an accident or when the driver of any vehicle <br /> 19 involved in an accident is physically or mentally <br /> incapable, or too intoxicated, to decide upon steps to be <br /> 20 taken to protect his or her property. <br /> 21 4. Whenever the driver of a vehicle is arrested and taken into <br /> 22 custody by a police officer, and the driver, because of <br /> intoxication or otherwise, is mentally incapable of <br /> deciding upon steps to be taken to safeguard his or her <br /> 23 property. <br /> 24 5. Whenever a police officer discovers a vehicle which he <br /> determines to be a stolen vehicle. <br /> 25 <br /> 6. Whenever any police officer finds a vehicle standing or <br /> 26 parked in a designated tow-away zone. <br /> 27 7. Whenever any police officer finds a vehicle immobilized for <br /> twenty-four (24) hours or longer as the result of the <br /> 28 vehicle having been declared a public nuisance pursuant to <br /> 29 the City's Parking Ordinance. <br /> 30 8. Whenever a vehicle without a special license plate, card, <br /> or decal indicating that the vehicle is being used to <br /> 31 transport a disabled person under RCW 46.16.380 is parked <br /> in a stall or space marked in accordance with requirements <br /> 32 of the City's Parking Ordinance on public property or on <br /> private property without charge. <br />
