• <br /> 1 <br /> 9. Whenever any police officer finds a vehicle standing or <br /> 2 parked in a fire lane or within fifteen (15) feet of any <br /> fire hydrant whether on public or private property. <br /> 3 <br /> Vehicles subject to impoundment under these or other sections are <br /> 4 hereby declared to be public nuisances which may be summarily <br /> abated as provided in each instance and except where prohibited <br /> 5 by law. Nothing in this section shall derogate from the powers <br /> of police officers under the common law. For the purposes of <br /> 6 this section, a place of safety may include the business location <br /> of a registered disposer as defined in RCW 46.52.102. <br /> 7 <br /> 8 be and the same is hereby amended as follows: <br /> 9 <br /> Officers authorized to remove certain vehicles. <br /> 10 <br /> A. Impoundments. <br /> 11 <br /> Any police officer may take custody of a vehicle and <br /> 12 provide for its prompt removal to a place of safety under any of <br /> the following circumstances: <br /> 13 <br /> 1 . Whenever any police officer finds a vehicle stopped or <br /> 14 parked upon the roadway, whether attended or unattended, <br /> the officer is hereby authorized to provide for the removal <br /> 15 of the vehicle or require the driver or other person in <br /> charge of the vehicle to move the vehicle to a position off <br /> 16 the roadway or away from the main travelled portion thereof; <br /> 17 2. Whenever any police officer finds a vehicle unattended upon <br /> 18 any highway where the vehicle constitutes an obstruction to <br /> traffic or jeopardizes public safety; <br /> 19 3. Whenever a police officer finds an unattended vehicle at <br /> 20 the scene of an accident or when the driver of any vehicle <br /> involved in an accident is physically or mentally <br /> 21 incapable, or too intoxicated, to decide upon steps to be <br /> taken to protect his or her property; <br /> 22 4. Whenever the driver of a vehicle is arrested and taken into <br /> 23 custody by a police officer, and the driver, because of <br /> intoxication or otherwise, is mentally incapable of <br /> 24 deciding upon steps to be taken to safeguard his or her <br /> property; <br /> 25 5. Whenever a police officer discovers a vehicle which he <br /> 26 determines to be a stolen vehicle; <br /> 27 6. Whenever any police officer finds a vehicle standing or <br /> parked in a designated tow-away zone; <br /> 28 7. Whenever any police officer finds a vehicle immobilized for <br /> 29 twenty-four (24) hours or longer as the result of the <br /> vehicle having been declared a public nuisance pursuant to <br /> 30 the City's Parking Ordinance; <br /> 31 8. Whenever a vehicle without a special license plate, card, <br /> or decal indicating that the vehicle is being used to <br /> 32 transport a disabled person under RCW 46.16.381 is parked <br /> 2 <br />
