1 B. Undulations should be four (4) inches in height at the <br /> highest point and a circular arc surface should be used <br /> 2 from point of rise to the end of the undulation. Three (3) <br /> inch high undulations can also be used. <br /> 3 <br /> C. Undulations should be placed approximately 600-700 feet <br /> 4 apart with minimum distance being about 400 feet. <br /> 5 D. Warning signs should be posted providing notice of the <br /> undulations; <br /> 6 <br /> E. The undulations should be tapered from zero elevation at <br /> 7 the gutter to the full undulation height approximately two <br /> to three feet from the gutter. Where rolled curb is used, <br /> 8 it may be necessary to place vertical posts on the sidewalk <br /> to prevent motorists from driving on it to bypass the <br /> 9 undulations. These posts should have high visibility <br /> during both day and night time conditions; <br /> 10 <br /> F. The undulations should not be placed over manholes, water <br /> 11 gates, junction chambers, etc. ; <br /> 12 G. The edge of the undulations should be at least five (5) <br /> feet from the edge of a driveway; <br /> 13 <br /> H. Whenever possible, undulations should be placed adjacent to <br /> 14 street lights; <br /> 15 I . Whenever possible, undulations should be placed on property <br /> lines rather than mid lot; and <br /> 16 <br /> J . Undulations should be placed on streets with pavements <br /> 17 having a reasonable life expectancy. <br /> 18 <br /> Section 3: THIRD PARTY LIABILITY. <br /> 19 <br /> It is expressly the purpose of this ordinance to provide for and <br /> 20 <br /> promote the health, safety and welfare of the general public and not to <br /> 21 <br /> create or otherwise establish or designate any particular class or group of <br /> 22 <br /> persons who will or should be especially protected or benefited by the terms <br /> 23 <br /> of this ordinance. <br /> 24 <br /> It is the specific intent of this ordinance that no provisions nor any <br /> 25 <br /> term used in this ordinance is intended to impose any duty whatsoever upon <br /> 26 <br /> the City or any of its officers or employees, for whom the implementation <br /> 27 <br /> and enforcement of this ordinance shall be discretionary and not mandatory. <br /> 28 <br /> Nothing contained in this ordinance is intended nor shall be construed <br /> 29 <br /> to create or form the basis of any liability on the part of the City, or its <br /> 30 <br /> officers, employees or agents, for any injury or damage resulting from the <br /> 31 <br /> implementation of this ordinance or by reason or in consequence of the <br /> 32 <br /> 2 <br />
