• <br /> ORDINANCE NO. <br /> AN ORDINANCE providing for the merger of <br /> substandard lots and amending the Zoning Code <br /> Ordinance No. 's 3572 and 3873 (Title 19 E.M.C.) <br /> WHEREAS, the City Council finds that pursuant to the City's police <br /> powers, it is necessary for the City to regulate the size of all lots within <br /> the City; and <br /> WHEREAS, the City Council finds that whenever new lot size <br /> regulations are adopted by the City, that this results in the creation of <br /> substandard lots - lots which are deficient in square footage and/or <br /> dimension; and <br /> WHEREAS, the City Council finds that when substandard lots are <br /> created, that they defeat the City's purpose in protecting the health and <br /> welfare of its citizenry and impede the City's ability to upgrade itself; and <br /> WHEREAS, the City Council finds that the City needs to adopt <br /> regulations which require the merger of substandard lots whenever possible; <br /> and <br /> WHEREAS, the City Council finds that when substandard lots are merged <br /> that they meet or exceed the minimum lot size and width requirements of the <br /> zone in which they are located, where appropriate, can be redeveloped with <br /> single family dwellings that are compatible with existing homes in the <br /> neighborhood and which do not detract from the character of single family <br /> neighborhoods; and <br /> WHEREAS, the Planning Commission has directed staff to further <br /> address the substandard lots in the context of the proposed zoning code <br /> revision, which will be presented to Council at a later date; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 3 of Ordinance No. 3873 as amended (E.M.C. <br /> 19.12.030, R-S Zone), which currently reads as follows: <br /> No lot shall be less than 12,500 sq. ft. in area; nor shall the lot <br /> width be less than 80 feet. EXCEPTION: Where a lot has an area of <br /> at least 7,000 sq. ft. and 60 feet width, as shown by the last <br /> conveyance of record on March 20, 1962, this regulation shall not <br /> prohibit one private dwelling and its accessory building on such <br /> lot. If a lot has an area less than 7,000 sq. ft. and a width of <br /> less than 60 feet, as shown by the last conveyance of record on <br /> March 20, 1962, a building permit may be used for one private <br /> dwelling and its accessory building PROVIDED; such lot of record <br />
