1 Section 5: That Section WAC 296-46-150 of the Department of Labor and <br /> 2 Industries Rules and Regulations for installing electric wires and equipment and <br /> 3 administrative rules as herein adopted be and is hereby amended by adding the <br /> 4 following: <br /> 5 <br /> Regardless of any other provisions in this chapter, all buildings, except for <br /> 6 dwelling occupancy, shall be wired in only metallic raceways. <br /> 7 <br /> Section 6: Each of the codes and regulations adopted by reference in <br /> 8 <br /> Section 2 of this ordinance is hereby amended by the addition of the following: <br /> 9 <br /> 10 Violations and Penalties. <br /> 11 Any person, firm or corporation violating any provision herein shall be <br /> deemed guilty of a misdemeanor and upon conviction thereof shall be <br /> 12 punishable by a fine not to exceed $1,000 or by imprisonment not to <br /> exceed 90 days or both fine and imprisonment. Each separate day or any <br /> 13 portion thereof during which any violation of this Code occurs or <br /> continues shall be deemed to constitute a separate offense, and upon <br /> 14 conviction thereof shall be punishable as herein provided. The issuance or <br /> granting of a permit or approval of plans and specifications shall not be <br /> 15 deemed or construed to be a permit for, or an approval of, any violation <br /> of any of the provisions of this Code. No permit presuming to give <br /> 16 authority to violate or cancel the provisions of this Code shall be valid, <br /> except insofar as the work or use which it authorized is lawful. <br /> 17 <br /> The issuance or granting of a permit or approval of plans shall not prevent <br /> 18 the Administrative Authority from thereafter requiring the correction of <br /> errors in said plans and specifications or from preventing construction <br /> 19 operations being carried on thereunder when in violation of this Code or <br /> of any other ordinance or from revoking any certificate of approval when <br /> 20 issued an error. <br /> 21 <br /> Section 7: AUTHORITY TO ABATE. <br /> 22 <br /> A. Any violation of this ordinance, the codes or regulations <br /> 23 <br /> herein adopted is hereby declared to be a nuisance. <br /> 24 <br /> B. Where a nuisance exists, the City Attorney on behalf of the City is <br /> 25 <br /> authorized to institute injunction, mandamus, or other appropriate action or proceeding <br /> 26 <br /> to prevent the violation of this ordinance. <br /> 27 <br /> C. Notwithstanding paragraph B, the City Attorney is authorized to apply to <br /> 28 <br /> any court of competent jurisdiction for and such court, upon hearing and for cause <br /> 29 <br /> shown, may grant a temporary or permanent injunction restraining any person, firm <br /> 30 <br /> and/or corporation from violating any provision of this ordinance or the codes herein <br /> 31 <br /> adopted and compelling compliance herewith. The cost of such action shall be taxed <br /> 32 <br /> against the violator. <br /> -7- <br />
