1 Section 5: That Section WAC 296-46-150 of the Department of Labor and 2 Industries Rules and Regulations for installing electric wires and equipment and 3 administrative rules as herein adopted be and is hereby amended by adding the 4 following: 5 Regardless of any other provisions in this chapter, all buildings, except for 6 dwelling occupancy, shall be wired in only metallic raceways. 7 Section 6: Each of the codes and regulations adopted by reference in 8 Section 2 of this ordinance is hereby amended by the addition of the following: 9 10 Violations and Penalties. 11 Any person, firm or corporation violating any provision herein shall be deemed guilty of a misdemeanor and upon conviction thereof shall be 12 punishable by a fine not to exceed $1,000 or by imprisonment not to exceed 90 days or both fine and imprisonment. Each separate day or any 13 portion thereof during which any violation of this Code occurs or continues shall be deemed to constitute a separate offense, and upon 14 conviction thereof shall be punishable as herein provided. The issuance or granting of a permit or approval of plans and specifications shall not be 15 deemed or construed to be a permit for, or an approval of, any violation of any of the provisions of this Code. No permit presuming to give 16 authority to violate or cancel the provisions of this Code shall be valid, except insofar as the work or use which it authorized is lawful. 17 The issuance or granting of a permit or approval of plans shall not prevent 18 the Administrative Authority from thereafter requiring the correction of errors in said plans and specifications or from preventing construction 19 operations being carried on thereunder when in violation of this Code or of any other ordinance or from revoking any certificate of approval when 20 issued an error. 21 Section 7: AUTHORITY TO ABATE. 22 A. Any violation of this ordinance, the codes or regulations 23 herein adopted is hereby declared to be a nuisance. 24 B. Where a nuisance exists, the City Attorney on behalf of the City is 25 authorized to institute injunction, mandamus, or other appropriate action or proceeding 26 to prevent the violation of this ordinance. 27 C. Notwithstanding paragraph B, the City Attorney is authorized to apply to 28 any court of competent jurisdiction for and such court, upon hearing and for cause 29 shown, may grant a temporary or permanent injunction restraining any person, firm 30 and/or corporation from violating any provision of this ordinance or the codes herein 31 adopted and compelling compliance herewith. The cost of such action shall be taxed 32 against the violator. -7-
