e-ek_ 9'6 <br /> 1 ORDINANCE NO. /5-, /-Q <br /> 2 <br /> AN ORDINANCE relating to harassment, adding a new chapter to the <br /> 3 Everett Criminal Code, EMC Chapter 10 (Ordinance No. <br /> 1145-85) . <br /> 4 <br /> 5 <br /> WHEREAS, the Everett City Council finds that the prevention of serious, <br /> 6 <br /> personal harassment is an important government objective. Toward that end, <br /> 7 <br /> this ordinance is aimed at making unlawful the repeated invasion of a <br /> 8 <br /> person's privacy by acts and threats which show a pattern of harassment <br /> 9 <br /> designed to coerce, intimidate, or humiliate the victim; and <br /> 10 <br /> WHEREAS, the Everett City Council further finds that the protection of <br /> 11 <br /> such persons from harassment can be accomplished without infringing on <br /> 12 <br /> constitutionally protected speech or activity; and <br /> 13 <br /> WHEREAS, this ordinance would bring the City of Everett into conformity <br /> 14 <br /> with existing State harassment laws; <br /> 15 <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 16 <br /> Section 1 : A new chapter is added to the Everett Criminal Code, EMC <br /> 17 <br /> Chapter 10, to be entitled "Harassment." <br /> 18 <br /> Section 2: HARASSMENT. <br /> 19 <br /> 1 . A person is guilty of harassment if: <br /> 20 <br /> a. Without lawful authority, the person knowingly threatens: <br /> 21 <br /> i . to cause bodily injury in the future to the person <br /> 22 threatened or to any other person; or <br /> 23 ii . to cause physical damage to the property of a person <br /> other than the actor; or <br /> 24 <br /> iii . to subject the person threatened or any other person <br /> 25 to physical confinement or restraint; or <br /> 26 iv. maliciously to do any other act which is intended to <br /> substantially harm the person threatened or another <br /> 27 with respect to his or her physical or mental health <br /> or safety; and <br /> 28 <br /> b. The person by words or conduct places the person threatened <br /> 29 in reasonable fear that the threat will be carried out. <br /> 30 2. A person who harasses another is guilty of a gross misdemeanor. <br /> 31 <br /> 32 <br />
