1 3. The penalties provided in this section for harassment do not <br /> 2 preclude the victim from seeking any other remedy otherwise available under <br /> 3 law. <br /> 4 Section 3: PLACE WHERE COMMITTED. <br /> 5 Any harassment offense committed as set forth in Section 2 of this <br /> 6 ordinance may be deemed to have been committed where the conduct occurred or <br /> 7 at the place from which the threat or threats were made or at the place <br /> 8 where the threats were received. <br /> 9 Section 4: COURT-ORDERED REQUIREMENTS UPON PERSON CHARGED WITH CRIME - <br /> 10 VIOLATION. <br /> 11 1 . Because of the likelihood of repeated harassment directed at <br /> 12 those who have been victims of harassment in the past, when any defendant <br /> 13 charged with a crime involving harassment is released from custody before <br /> 14 trial on bail or personal recognizance, the court authorizing the release <br /> 15 may require that the defendant: <br /> 16 a. Stay away from the home, school , business, or place of <br /> employment of the victim or victims of the alleged offense <br /> 17 or other location, as shall be specifically named by the <br /> court in the order; <br /> 18 b. Refrain from contacting, intimidating, threatening, or <br /> 19 otherwise interfering with the victim or victims of the <br /> alleged offense and such other persons, including but not <br /> 20 limited to members of the family or household of the <br /> victim, as shall be specifically named by the court in the <br /> 21 order. <br /> 22 2. An intentional violation of a court order issued under this <br /> 23 section is a misdemeanor. The written order releasing the defendant shall <br /> 24 contain the court' s directives and shall bear the legend: Violation of this <br /> 25 order is a criminal offense under Chapter 9A.46 RCW and/or Chapter <br /> 26 EMC (Ordinance No. / ?,- X7) . A certified copy of the order shall be <br /> 27 provided to the victim by the clerk of the court. <br /> 28 Section 5: ARRAIGNMENT - NO-CONTACT ORDER. <br /> 29 A defendant who is charged by citation, complaint, or information with <br /> 30 an offense involving harassment and not arrested shall appear in court for <br /> 31 arraignment in person as soon as practicable, but in no event later than <br /> 32 fourteen (14) days after the next day on which court is in session following <br /> 2 <br />
