• 1 Section 9: NON-LIABILITY OF PEACE OFFICER. 2 A peace officer shall not be held liable in any civil action for an 3 arrest based on probable cause, enforcement in good faith of a court order, 4 or any other action or omission in good faith under this ordinance arising 5 from an alleged incident of harassment brought by any party to the incident. 6 Section 10: VIOLATION OF ANTI-HARASSMENT PROTECTION ORDER. 7 1 . Any respondent who wilfully disobeys any temporary 8 anti-harassment protection order or civil anti-harassment protection order 9 issued pursuant to Chapter 10.14 RCW, as now or hereafter amended, shall be 10 guilty of a gross misdemeanor. 11 2. As used in this section, "respondent" means the respondent of a 12 temporary anti-harassment protection order or civil anti-harassment 13 protection order issued under Chapter 10.14 RCW, as now or hereafter amended. 14 Section 11 : SEVERABILITY. 15 Should any section, subsection, paragraph, sentence, clause or phrase 16 of this ordinance or its application to any person or situation be declared 17 unconstitutional or invalid for any reason, such decision shall not affect 18 the validity of the remaining portions of this ordinance or its application 19 to any other person or situation. The City Council of the City of Everett 20 hereby declares that it would have adopted this ordinance and each section, 21 subsection, sentence, clause, phrase or portion thereof irrespective of the 22 fact that any one or more sections, subsections, sentences, clauses, phrases 23 or portions be declared invalid or unconstitutional . 24 Section 12: THIRD PARTY LIABILITY. 25 It is expressly the purpose of this ordinance to provide for and 26 promote the health, safety and welfare of the general public and not to 27 create or otherwise establish or designate any particular class or group of 28 persons who will or should be especially protected or benefited by the terms 29 of this ordinance. 30 31 4 32
