• 1 ORDINANCE NO./50/-'Q 4 2 3 AN ORDINANCE amending Ordinance No. 4056 (Chapter 13.12 EMC) to 4 provide for the placement of temporary seating facilities on sidewalks and providing an appeals process. 5 6 THE CITY OF EVERETT DOES ORDAIN: Section 1 : Section 3 of Ordinance No. 4056 (EMC 13.12.020) which reads 8 as follows: 9 10 Objects on sidewalks unlawful ; exception: 11 It shall be unlawful for any person, persons, corporations or other entities to cause to be placed upon any sidewalk area in 12 the City of Everett or to permit to be placed upon or to occupy any sidewalk area within the City of Everett any object of any 13 sort or any article whatsoever except certain receptacles or containers approved by the City Council of the City of Everett. 14 15 be and the same is hereby amended to read as follows: 16 Objects on sidewalks unlawful ; exception: 17 It shall be unlawful for any person, persons, corporations 18 or other entities to cause to be placed upon any sidewalk area in the City of Everett or to permit to be placed upon or to occupy 19 any sidewalk area within the City of Everett any object of any sort or any article whatsoever except certain objects approved by 20 the Director of Public Works or his designee. This Chapter does not regulate the placement of newspaper stands. 21 22 Section 2: Section 4 of Ordinance No. 4056 (EMC 13.12.030) which reads 23 as follows: 24 Objects permitted upon sidewalk areas: 25 With the consent of the City Council , upon application 26 being made to said City Council , the following objects may be placed upon the sidewalk areas in the City of Everett under such 27 conditions and in such manner as the City Council may approve, to-wit: 28 (1 ) Containers for shrubs or trees. Receptacles or 29 containers for shrubs or trees which tend to beautify the City of Everett. 30 (2) Trash containers. Containers or receptacles provided 31 for the deposit of trash or other refuse matter. 32
