Telephone booths installed under <br /> the direction of the telephone company authorized to do business <br /> 2 in the City of Everett. <br /> 3 (4) Display merchandise. Display of merchandise when in <br /> connection with a special occasion or merchant promotional <br /> 4 activity, provided such exception shall not be granted by the <br /> City Council for a period in excess of fourteen (14) days. <br /> 5 <br /> 6 be and the same is hereby amended to read as follows: <br /> 7 <br /> Objects permitted upon sidewalks areas: <br /> 8 <br /> With the consent of the Director of Public Works or his <br /> 9 designee, upon application being made to the Public Works <br /> Department, the following objects may be placed upon the sidewalk <br /> 10 areas in the City of Everett as long as it is done in accordance <br /> with all City ordinances and regulations adopted by the Director <br /> 11 of Public Works or his designee, to-wit: <br /> 12 (1 ) Containers for shrubs or trees. Receptacles or <br /> containers for shrubs or trees which tend to beautify the City of <br /> 13 Everett. <br /> 14 (2) Trash containers. Containers or receptacles provided <br /> for the deposit of trash or other refuse matter. <br /> 15 <br /> (3) Telephone booths. Telephone booths installed under <br /> 16 the direction of the telephone company authorized to do business <br /> in the City of Everett. <br /> 17 <br /> (4) Display merchandise. Display of merchandise when in <br /> 18 connection with a special occasion or merchant promotional <br /> activity, provided such exception shall not be granted by the <br /> 19 City Council for a period in excess of fourteen (14) days. <br /> 20 (5) Temporary/seasonal seating for restaurants. <br /> 21 <br /> Section 3: Section 5 of Ordinance No. 4056 (EMC 13.12.040) which reads <br /> 22 <br /> as follows: <br /> 23 <br /> 24 Special conditions: <br /> 25 The City Council in its discretion, in order to protect the <br /> public health, safety and welfare, may require a person placing a <br /> 26 permitted object upon the sidewalk area to file with the City <br /> Clerk an indemnity agreement saving harmless the City of Everett <br /> 27 from responsibility for injury or damage to any person or thing <br /> as a result of such object being placed upon the sidewalk area <br /> 28 and may further require a bond conditioned that said individual <br /> so placing such permitted object upon the sidewalk area will <br /> 29 indemnify the City from damages as a result of such object being <br /> placed on the said sidewalk area. <br /> 30 <br /> 31 be and the same is hereby amended to read as follows: <br /> 32 <br /> 2 <br />
