<br />     			AN ORDINANCE CREATING  A SPECIAL  FUND  ENTITLED  "S.R.  527  and  116th  Street  S.E.
<br />     			Intersection   Improvements,"   Fund   317   to   accumulate   all   the   design   and
<br />     			construction  costs  for  the  intersection  improvments  project,  including  traffic
<br />     			signal  and  roadway improvements.
<br />     			WHEREAS,  the  Washington  State  Department  of  Transportion  has  planned  a  safety
<br />     			improvement porject  for  the intersection of S.R.  527 and 116th Street S.E. ,  and
<br />     			WHEREAS,   the  City  has  recently  annexed  the  project  area  into  the  corporate
<br />     			limits of  the  City,  and
<br />     			WHEREAS,  on  April  25,   1985  the  State  has  agreed  to  transfer  funding  to  the
<br />     			City  and  the  City  agrees  to  act  as  lead  agency  in  designing  and  constructing
<br />     			the intersection improvements under the  federal grant  HES-2723(2),  and
<br />     			WHEREAS,  on  October  30,  1985,  Ordinance  1181-85,  entitled  "Traffic  Engineering
<br />     			Improvements"   was   passed   which   repealed   Ordinance   1036-84,    and   budgeted
<br />     			preliminary  engineering in the following  program:
<br />    				Fund    368,    Program   354,    entitled    "S.R.    527   and   116th   Street   S.E.
<br />    				Intersection Design," $60,000.00
<br />     			WHEREAS,   on   August   21,   1986,   the   City   entered   an   agreement   with   Entranco
<br />     			Engineers,    Inc.    to   provide   preliminary   engineering   for   the   intersection
<br />     			improvements,  and
<br />     			WHEREAS,  investigations  by  Entranco  Engineers  showed  that  a  traffic  signal  was
<br />     			warranted   and   should   be   included   into   the   scope   of   the    intersection
<br />     			improvements,  and
<br />     			WHEREAS,   on   April   3,   1987,   the   City   entered   a   supplement   agreement   with
<br />     			Entranco  Engineers,  Inc.  to  include  the  design  of  a  traffic  signal  with  the
<br />     			intersection improvements,  and
<br />     			WHEREAS,   the   federal  grant   HES-2723(2)   specifically   excludes   the   following
<br />     			items for  reimbursement:
<br />						Traffic Signal Design and Construction
<br />						Illumination Design and Construction
<br />						Channelization Design and Construction
<br />						Right of Way  Acquisition
<br />      			NOW,  THEREFORE,  THE CITY OF EVERETT DOES ORDAIN THAT:
<br />      			Section 1.  A   special   construction   fund   is   hereby   established   as   Fund   317
<br /> 						entitled  "S.R.  527  and  116th Street  S.E.  Intersection  Improvements"
<br /> 						to  accumulate  the  design  and  construction  costs  required  to  design
<br /> 						and   construct   the   intersection   improvements,    including   roadway
<br /> 						improvements,   traffic  signal,   right  of  way  acquisition  and  other
<br /> 						necessary  improvements.
<br />      			Section  2.  Authorization    is    hereby    given    to    transfer    the    preliminary
<br /> 						engineering     funds     from     the     existing     "Traffic     Engineering
<br /> 						Improvements"  Fund  368,  Program  354,  to  the  new  fund  317,  Programs
<br /> 						946   and   947,    "S.R.    527   and   116th   Street    S.E.    Intersection
<br /> 						Improvements."
<br />      			Section  3.  Authorization  is  hereby  given  to  accumulate  costs  and  distribute
<br /> 						payments  from  Fund  317,  Program  946,  for design  and  construction of
<br /> 						the   grant   eligible   intersection   improvements,   excluding;   traffic
<br /> 						signal,  illumination,  channelization and right of way  acquisition.
<br />      			Section  4.  Authorization  is  hereby  given  to  accumulate  costs  and  distribute
<br /> 						payments  from Fund  317,  Program  947,  for design  and  construction of
<br /> 						the  grant  ineligible  intersection  improvements,   including;  traffic
<br /> 						signal,  illumination,  channelization and right of way acquisition.
