Section 2: That the City of Everett shall not be responsible nor liable for storm drainage runoff resulting from existing drainage patterns as established on City rights-of-way that may currently, or in the future, go over, under, or across the above-described street vacation. Section 3: In accordance with Everett Resolution No. 1724, since the area vacated exceeds the area(s) dedicated, the proponent/petitioner/owners is required to compensate the City of Everett in an amount equal to one-half (1/2) the current appraised value of the area herein described. The abutting property owners shall have ninety (90) days following passage of this ordinance to exercise this vacation. Unless otherwise amended by City Council, this ordinance shall be null and void if the abutting property owner(s) fail to exercise this condition within ninety (90) days following passage of this ordinance. Section 4: That this ordinance shall not become effective until the proponents/petitioners/owners convey to the City of Everett, by Statutory Warranty Deed, the following described parcels for street and utility purposes: Parcel 1 (Dedication) That portion of Lot "A", South Highway Addition to the City of Everett, as per plat recorded in Volume 12 of Plats on page 10, records of Snohomish County, Washington, described as follows: Commencing at the southwest corner of said Lot "A"; thence N5°46'00"E along the West line of said Lot "A", 183.75 feet to the True Point of Beginning; thence N50°46'00"E 7.07 feet; thence S84°14'00"E 59.91 feet to a point of curvature, the radius center of which bears S5°46'00"W 68.16 feet distant; thence along the arc of a curve to the right through a central angle of 47°55'59" an arc distance of 57.02 feet, to the southwesterly right-of-way margin of Wilmington Avenue as shown on said plat, being also a point of curvature, the radius center of which bears N53°41'59"E 659.43 feet distant; thence along said right-of-way margin, northwesterly on the arc of a curve to the right through a central angle of 11°05'53" an arc distance of 127.73 feet; thence N84°14'00"W 27.72 feet; - 3 -
