• <br /> 1 shall be guilty of a misdemeanor, and each such person shall be deemed <br /> 2 guilty of a separate offense for each and every day during which any <br /> 3 violation of any of the provisions of this Chapter is committed, continued, <br /> 4 or permitted; and upon conviction of any such violation, such person shall <br /> 5 be subject to a fine of not more than one thousand dollars ($1 ,000) or <br /> 6 imprisonment for not more than ninety days, or both such fine and <br /> 7 imprisonment. <br /> 8 A. Violation. Injunctive action. Any violation of the <br /> 9 provisions of this Chapter constitutes a public nuisance which the City can <br /> 10 abate by an action in Snohomish County Superior Court. The costs of such <br /> 11 action shall be taxed against the violator. <br /> 12 B. Provisions Nonexclusive. Penalty and enforcement provisions <br /> 13 provided in this Chapter are not exclusive, and the City may pursue any <br /> 14 remedy or relief it deems appropriate. <br /> 15 Section 20: SEVERABILITY. <br /> 16 Should any section, subsection, paragraph, sentence, clause or phrase <br /> 17 of this Chapter or its application to any person or situation be declared <br /> 18 unconstitutional or invalid for any reason, such decision shall not affect <br /> 19 the validity of the remaining portions of this Chapter or its application to <br /> 20 any other person or situation. The City Council of the City of Everett <br /> 21 hereby declares that it would have adopted this Chapter and each section, <br /> 22 subsection, sentence, clause, phrase or portion thereof irrespective of the <br /> 23 fact that any one or more sections, subsections, sentences, clauses, phrases <br /> 24 or portions be declared invalid or unconstitutional . <br /> 25 Section 21 : REPEALER. <br /> 26 Chapters 5 and 6 of Ordinance No. 295-74 and all other ordinances and <br /> 27 provisions in conflict herewith are hereby repealed. <br /> 28 Section 22: THIRD PARTY LIABILITY. <br /> 29 It is expressly the purpose of this Chapter to provide for and promote <br /> 30 the health, safety and welfare of the general public, and not to create or <br /> 31 otherwise establish or designate any particular class or group of persons <br /> 32 • <br /> 14 <br />
