• • • • 1 renewal license shall be issued unless the full amount of the security 2 deposit for litter cleanup is on deposit with the City at the time of the 3 application for renewal . If funds sufficient to replenish the fund are not 4 received within five (5) days of receipt of written notice then the license 5 shall be suspended until sufficient funds are received. Within the five (5) 6 days of receipt of notice of deficiency, the licensee may inform the Clerk 7 in writing of circumstances justifying non-payment of additional funds which 8 information shall be considered by the Clerk and the license shall not be 9 suspended if the non-payment in the opinion of the Clerk is justified. 10 C. If the funds for security for cleanup are fully expended within 11 any one week, or if the funds for cleanup fall below $50.00 twice in any 12 quarter or five times in any year, then the Clerk shall require an 13 additional cash deposit of the higher of $200.00 or the greatest one week 14 expenditure for cleanup during the prior year. 15 D. Upon termination of all activities authorized by a public dance 16 license and cleanup of all litter resulting from such an activity, the 17 remainder of all funds deposited as security for litter cleanup shall be 18 refunded to the licensee, without interest. 19 Section 17: AUTHORITY OF THE DIRECTOR. 20 A. The City Clerk is authorized to: 21 22 1 . Make rules for the interpretation and implementation of this ordinance; 23 2. Grant, renew, deny, suspend or revoke licenses 24 according to the terms of this Chapter; 25 3. Collect fees for the application according to the terms of this Chapter. 26 27 Section 18: OPERATING WITHOUT A LICENSE - PENALTY. 28 Any person who shall conduct or operate a public dance or public dance 29 hall without a valid license issued pursuant to this Chapter shall be guilty 30 of a misdemeanor. 31 Section 19: VIOLATION - PENALTY - MISDEMEANOR. 32 Any person, firm or corporation violating any provision of this Chapter 13
