• <br /> -•tib <br /> } • y <br /> • <br /> 1 ORDINANCE NO. /-54/o—1I <br /> 2 AN ORDINANCE establishing the use of lead-free pipes, solders and <br /> 3 fluxes and amending Ordinance No. 1249-86 and the 1985 Uniform <br /> Plumbing Code by the addition of a new Chapter 1 .4. <br /> 4 <br /> 5 WHEREAS, the 1986 Safe Drinking Water Act (PL99-339) establishes <br /> 6 standards for lead-free water plumbing materials which pre-empt state and <br /> 7 local regulations, and <br /> 8 WHEREAS, the City Council of the City of Everett wishes to bring <br /> 9 private and public drinking water supply facilities into compliance with <br /> 10 said law, <br /> 11 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 12 An additional chapter 14 is hereby added to the 1985 Uniform Plumbing <br /> 13 Code (adopted by Ordinance No. 1249-86) as follows: <br /> 14 <br /> 15 A. IN GENERAL <br /> 16 1 . Prohibition: Any pipe, solder, or flux, which is <br /> used after the enactment of the Safe Drinking Water <br /> 17 Act Amendments of 1986, in the installation or repair <br /> of: <br /> 18 <br /> a. any public water system, or <br /> 19 b. any plumbing in a residential or <br /> 20 nonresidential facility providing water <br /> for human consumption which is connected <br /> 21 to a public water system, <br /> 22 shall be lead free (within the meaning of <br /> subsection C. This paragraph shall not apply to <br /> 23 leaded joints necessary for the repair of cast iron <br /> pipes. <br /> 24 <br /> 2. Public Notice Requirements: <br /> 25 <br /> a. In General - The Utilities Division shall <br /> 26 identify and provide notice to persons that may <br /> be affected by lead contamination resulting <br /> 27 from either or both of the following: <br /> 28 (i ) The lead content in the construction <br /> materials of the public water <br /> 29 distribution system. <br /> 30 (ii ) Corrosivity of the water supply <br /> sufficient to cause leaching of lead. <br /> 31 The notice shall be provided in such manner and form <br /> 32 as may be reasonably required by the Administrator of <br />
