• -•tib } • y • 1 ORDINANCE NO. /-54/o—1I 2 AN ORDINANCE establishing the use of lead-free pipes, solders and 3 fluxes and amending Ordinance No. 1249-86 and the 1985 Uniform Plumbing Code by the addition of a new Chapter 1 .4. 4 5 WHEREAS, the 1986 Safe Drinking Water Act (PL99-339) establishes 6 standards for lead-free water plumbing materials which pre-empt state and 7 local regulations, and 8 WHEREAS, the City Council of the City of Everett wishes to bring 9 private and public drinking water supply facilities into compliance with 10 said law, 11 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: 12 An additional chapter 14 is hereby added to the 1985 Uniform Plumbing 13 Code (adopted by Ordinance No. 1249-86) as follows: 14 15 A. IN GENERAL 16 1 . Prohibition: Any pipe, solder, or flux, which is used after the enactment of the Safe Drinking Water 17 Act Amendments of 1986, in the installation or repair of: 18 a. any public water system, or 19 b. any plumbing in a residential or 20 nonresidential facility providing water for human consumption which is connected 21 to a public water system, 22 shall be lead free (within the meaning of subsection C. This paragraph shall not apply to 23 leaded joints necessary for the repair of cast iron pipes. 24 2. Public Notice Requirements: 25 a. In General - The Utilities Division shall 26 identify and provide notice to persons that may be affected by lead contamination resulting 27 from either or both of the following: 28 (i ) The lead content in the construction materials of the public water 29 distribution system. 30 (ii ) Corrosivity of the water supply sufficient to cause leaching of lead. 31 The notice shall be provided in such manner and form 32 as may be reasonably required by the Administrator of
