WHEREAS, the Owner has agreed to develop the aformentioned property as in accordance with the requirements of this Agreement in consideration of the City considering designating the property M-M Medium Manufacturing and the Owner further agrees as part of said consideration that should the City zone the property M-M Medium Manufacturing, to lay out, develop and maintain '', the property as hereinafter set forth; NOW THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS: 1. Any development of this property shall be subject to a master site plan review process covering the entire property. This site plan shall be subject to the conditions of approval required by the Everett Planning Commission following a public hearing. Specific requests for Building Permits will require a detailed site plan review by the Planning Department. Detailed drawings in accordance with City Design and Construction Standards shall be submitted to the Public Works Department showing site parking layout, landscaping, utilities, storm drainage, temporary construction erosion control and all required improvements in the public right-of-way. Public Works Department and Planning Department approval of these drawings is required prior to any permits being issued. All required improvements shall be completed, approved and warranted or bonded before the Occupancy Permit is issued. 2. Permitted Uses a. The following uses shall be permitted on this property within one thousand (1000) feet of that area to the north which is designated for residential uses subject to the requirements and provisions of applicable City Ordinances and standards: -2-
