• <br /> EXHIBIT 2 <br /> CONCOMITANT AGREEMENT TO REZONE ORDINANCE NO./', 't,-2c? <br /> SIGMA DEVELOPMENT, INC PROPERTY <br /> THIS AGREEMENT is made and entered this 2‘7g, day of iiiini4nry, <br /> 1989, by Sigma Development, Inc. , said party being hereinafter referred to <br /> as "Owner", and the City of Everett, a municipal corporation under the laws <br /> of the State of Washington, hereinafter referred to as the "City"; <br /> WITNESSETH: <br /> WHEREAS, the Owner has made application to the City to establish <br /> zoning on the parcel of property described in the Ordinance which is marked <br /> Exhibit "A," attached hereto and incorporated herin by reference; and <br /> WHEREAS, The Owner is the owner of a tract of real property <br /> approximately one hundred five (105) acres in size located generally north <br /> of Seaway Boulevard, west of Powder Mill Gulch, south of the Plat of <br /> Kenilworth Hills No. 1 (Plat #1-83) , and east of the extended centerline of <br /> Paine Field Airport's main runway, the legal description of which is <br /> attached hereto as Exhibit B and incorporated herein by this reference; and <br /> WHEREAS, the rezoning designation authorized by Ordinance No/44e4.--E? <br /> and development of the property described in Exhibit B in accordance with <br /> the requirements of this Agreement will allow uses which are more compatible ? <br /> with the surrounding industrial park designated property to the south, west <br /> and east, and such development can occur in a manner which is compatible <br /> with the established residential neighborhood to the north; and <br /> WHEREAS, the public health, safety, and welfare would be best served <br /> by anticipating the impact of such development and imposing certain mutually <br /> agreed upon standards, conditions and requirements as set forth herein and <br /> hereafter considered to be an integral part of the zoning restrictions <br /> applicable to said property; and <br />
