Agreed Order <br /> If the respondents are not Repeat Violators (see Paragraph 1) and have completed <br /> the minimum corrective action described in this citation, he/she is eligible to enter <br /> into an agreed order with the city. The agreed order means that the city agrees that <br /> it will not take further action against the respondents regarding the violations <br /> described in this citation as long as there are no further nuisance-related EMC <br /> violations for the two-year period following the date of the order. <br /> If the Respondents are eligible to enter into an agreed order with the city, and sign <br /> the agreed order, the Res�ondents are no longer required to appear at the hearinq <br /> set forth in Paragraph 6. The Code Officer listed below must be contacted to <br /> schedule an ins�ection of the property if the Respondents wish to apply for an <br /> aqreed order. <br /> NOTHING HEREIN RELIEVES RESPONDENTS FROM THEIR OBLIGATION TO <br /> COMPLY WITH ALL APPLICABLE CODES. <br /> 8. Hearing Examiner <br /> Following the hearing, the Violations Hearing Examiner may issue an order against <br /> the Respondents, even if he/she does not attend the hearing. The <br /> Hearing Examiners' Order may: <br /> A. Require that the violations be corrected by a specific date; <br /> B. Impose a monetary penalty in accordance with Chapter 1.20 EMC; <br /> C. Authorize the City to enter the property, correct the violations and to <br /> assess the costs of the corrections, as permitted by law. <br /> The City will make the Proposed Order and the exhibits available to the Respondents <br /> one business day prior to the hearing. To obtain a copy please contact the <br /> undersigned Code Enforcement Officer at least two business days in advance to <br /> allow for the preparation of the exhibits. Documents can be picked up at the Police <br /> Department Records Unit counter located on the first floor at 3002 Wetmore <br /> Avenue.
