Exhibits conduct in driving or operating a taxicab or for-hire vehicle <br /> 2 which would lead the City Clerk to reasonably conclude that the <br /> applicant will not comply with the provisions of the ordinance related <br /> 3 to driver/operator conduct or the safe operation of the vehicle; <br /> 4 K. Violates any of the provisions of this ordinance; or <br /> 5 L. Fails to promptly deliver to the City's Police Department, within <br /> twenty-four hours, all property of value left unattended by any <br /> 6 passenger in any for-hire vehicle. <br /> 7 Section 18: VEHICLE OCCUPANCY - DRIVER'S WORKING HOURS - DRIVER'S <br /> CONDITION <br /> 8 <br /> A. It is unlawful for any person other than paying passengers and the <br /> 9 driver thereof to occupy any for-hire vehicle, provided that this <br /> section shall not prohibit the carrying of other employees of the owner <br /> 10 of said taxicab when acting within the scope of his/her business, nor <br /> prohibit the making of necessary repairs. <br /> 11 <br /> B. It is unlawful for any person to engage in any work or employment for <br /> 12 more than twelve hours in any twenty-four-hour period of time during <br /> any part of which he/she is engaged in the occupation of driver for a <br /> 13 for-hire vehicle. <br /> 14 C. It is unlawful for any for-hire driver to consume any alcoholic <br /> beverage prior to reporting for duty, or while on duty as a driver or <br /> 15 to operate any for-hire vehicle while under the influence of or <br /> affected by intoxicating liquors, narcotics, barbiturates or any <br /> 16 medicine that shall impair his/her ability to drive. <br /> 17 Section 19: VEHICLE EQUIPMENT, MAINTENANCE AND INSPECTION <br /> 18 A. All for-hire vehicles may be inspected from time to time as determined <br /> by the Chief of Police in response to complaints received or <br /> 19 observations that such is desirable, for the purpose of determining <br /> proper equipment and safe, healthy, and sanitary conditions for the <br /> 20 transportation of passengers, providing that inspections shall be <br /> conducted at least annually. The Chief of Police may promulgate rules <br /> 21 and regulations which set forth standards of safety, health, and <br /> sanitation required for for-hire vehicles and the scope of for-hire <br /> 22 vehicles inspections, including but not limited to standards regarding <br /> cleanliness, brakes, lights, tires, glass, seat belts, and any special <br /> 23 equipment that may be required. <br /> 24 B. Each for-hire vehicle shall be equipped and maintained at all times by <br /> the owner or operator for safety, cleanliness and lawful operation in <br /> 25 accordance with the laws of the City and the State and shall be <br /> furnished with such equipment as the Chief of Police shall deem <br /> 26 necessary for such safe operation. All vehicles for hire, prior to <br /> being licensed under the provisions of this ordinance shall be <br /> 27 inspected by an independent certified mechanic at the applicant's <br /> expense and approved by the Chief of Police. The Chief of Police shall <br /> 28 have authority to require that routine inspections be made from time to <br /> time as he/she deems necessary and appropriate. The Chief of Police <br /> 29 may promulgate inspection regulations which shall be filed in the <br /> office of the City Clerk. The items to be inspected shall be listed on <br /> 30 a form to be provided by the Chief of Police. Each item on said list <br /> shall be in satisfactory condition before any license may be issued or <br /> 31 renewed under the provisions of this ordinance. <br /> 32 <br /> 12 <br />
