1 34 City Non-Liability 35 Violation - Penalty 2 36 Rules and Regulations 37 Title - Gender 3 38 Conflicting Provisions 39 Severability 4 40 Repealer 41 Effective Date 5 6 Section 2: DEFINITIONS 7 For the purposes of this ordinance, words and phrases used herein shall 8 mean as follows: 9 A. "Cruising" means the driving of a for-hire vehicle on the streets, 10 alleys or public places of the City in search of, or soliciting, prospective passengers for hire; 11 B. "Driver", "For-Hire Driver", and "Operator" mean any person, whether 12 agent, employee, contractor, subcontractor or lessee authorized to operate or physically engage in driving a for-hire vehicle carrying 13 passengers or baggage for hire, whether or not said person is the owner of or has any financial interest in the ownership of said vehicle; 14 provided, however, that the provisions of this ordinance shall not apply to drivers of motor vehicles operated by any municipal or 15 privately owned, licensed non-profit transit system; 16 C. "Taxicab stand" means a designated area which is to be used exclusively by taxicabs which are licensed as provided in this ordinance; 17 D. "Operate" or "Engage in the business of operating any taxicab or 18 vehicle for hire" means waiting at a taxicab stand or the pickup and transportation of any fare paying passenger from a point within the 19 geographical confines of the City of Everett, whether or not the vehicle is dispatched from a taxicab stand or office within any other 20 municipal corporation, and whether or not the ultimate destination or 21 route of travel is within the confines of the City of Everett; provided, that nothing in this ordinance shall be construed to apply to 22 taxicabs or for-hire vehicles licensed by any other municipal corporation and transporting passengers from a point within the 23 licensing municipality to a destination outside thereof, whether or not the ultimate destination or route traveled is within the City of Everett; 24 25 E. "Holder" means a person to whom a license has been issued; 26 F. "Person" includes an individual , a corporation, a partnership, any unincorporated association, or legal entity; 27 G. "Owner" means the registered owner as defined by the Revised Code of 28 Washington (RCW) 46.04.460, as now or hereafter amended; 29 H. "Licensee" means all applicants, including affiliation representative, required to license taxicabs or for-hire vehicles under the provisions 30 of this ordinance; 31 I. "Trip Sheet" means a daily record prepared by a taxicab driver of all trips made by said driver showing time and place of origin, 32 destination, number of passengers and the amount of fare of each trip; 2
