y ' 4 <br /> provisions of Chapter 5.04 Everett Municipal Code or any other ordinance, <br /> 1 <br /> 2 the provisions set forth in this ordinance shall supersede. <br /> 3 Section 39: SEVERABILITY <br /> 4 Should any section, subsection, paragraph, sentence, clause or phrase <br /> 5 of this ordinance or its application to any person or situation be declared <br /> 6 unconstitutional or invalid for any reason, such decision shall not affect <br /> the validity of the remaining portions of this ordinance or its application <br /> l <br /> 8 to any other person or situation. The City Council of the City of Everett <br /> 9 hereby declares that it would have adopted this ordinance and each section, <br /> 10 subsection, sentence, clause, phrase or portion thereof irrespective of the <br /> 11 fact that any one or more sections, subsections, sentences, clauses, phrases <br /> 12 or portions be declared invalid or unconstitutional . <br /> 13 Section 40: REPEALER <br /> Chapter 17 of Ordinance No. 295-74 and Ordinance No. ' s 779-81 , 910-82 <br /> 14 <br /> 15 and 1100-85 are hereby repealed. All other ordinances or parts thereof in <br /> 16 conflict herewith are hereby repealed. <br /> 17 Section 41 : EFFECTIVE DATE <br /> 18 This ordinance shall become effective January 1 , 1988. At that time <br /> 19 all for-hire businesses and for-hire drivers shall be required to obtain <br /> 20 licenses in accordance with the provisions of this ordinance. In order to <br /> 21 implement this ordinance, the licenses issued from January 1 , 1988 through <br /> 22 May 31 , 1988, shall be half yearly licenses which licenses shall be valid <br /> 23 until July 31 , 1988. The fee for these half yearly licenses shall be <br /> 24 one-half of the initial license fee as set forth in Section 6 of this <br /> 25 ordinance. <br /> 26 <br /> 27 WILLIAM E.
