• <br /> 1 Section 35: VIOLATION - PENALTY <br /> 2 Any person, firm or corporation violating any provision of this <br /> 3 ordinance shall be guilty of a misdemeanor, and each such person shall be <br /> 4 deemed guilty of a separate offense for each and every day during which any <br /> 5 violation of any of the provisions of this ordinance is committed, <br /> 6 continued, or permitted; and upon conviction of any such violation, such <br /> 7 person shall be subject to a fine of not more than one thousand dollars <br /> 8 ($1 ,000) or imprisonment for not more than ninety days, or both such fine <br /> 9 and imprisonment. <br /> 10 A. Violation. Injunction action. Any violation of the provisions of <br /> this ordinance constitutes a public nuisance which the City can abate <br /> 11 by an action in Snohomish County Superior Court. The costs of such <br /> action shall be taxed against the violator. <br /> 12 <br /> B. Civil penalty. In addition to or as an alternative to any other <br /> 13 penalty provided herein or by law any person who violates any provision <br /> of this ordinance shall be subject to a civil penalty in an amount not <br /> 14 to exceed two hundred fifty dollars per violation to be directly <br /> assessed by the Director of Weights and Measures. The Director, in a <br /> 15 reasonable manner, may vary the amount of the penalty assessed to <br /> consider the appropriateness of the penalty to the violator; the <br /> 16 gravity of the violation; the number of past and present violations <br /> committed and the good faith of the violator in attempting to achieve <br /> 17 compliance after notification of the violation. All civil penalties <br /> assessed will be enforced and collected in accordance with the <br /> 18 procedure specified herein and in accordance with the rules promulgated <br /> hereunder. <br /> 19 <br /> C. Provisions Nonexclusive. Penalty and enforcement provisions provided <br /> 20 in this article are not exclusive, and the City may pursue any remedy <br /> or relief it deems appropriate. <br /> 21 <br /> Section 36: RULES AND REGULATIONS <br /> 22 <br /> The Chief of Police, City Clerk and Weights and Measures Director are <br /> 23 <br /> authorized to promulgate rules and regulations for the operation of for-hire <br /> 24 <br /> vehicles consistent with the terms of this ordinance. <br /> 25 <br /> Section 37: TITLE - GENDER <br /> 26 <br /> A. All references in the ordinance to the City Clerk, Chief of Police and <br /> 27 Director of Weights and Measures shall include their respective <br /> designees. <br /> 28 <br /> B. Any reference to or use of the terms "he," "she," "him," "her," , or <br /> 29 other gender-based classification, if applicable as shown by the <br /> context thereof, shall apply to the opposite gender, also. <br /> 30 <br /> Section 38: CONFLICTING PROVISIONS <br /> 31 <br /> In the event any of the provisions of this ordinance conflict with any <br /> 32 <br /> 21 <br />
