• 1 Section 35: VIOLATION - PENALTY 2 Any person, firm or corporation violating any provision of this 3 ordinance shall be guilty of a misdemeanor, and each such person shall be 4 deemed guilty of a separate offense for each and every day during which any 5 violation of any of the provisions of this ordinance is committed, 6 continued, or permitted; and upon conviction of any such violation, such 7 person shall be subject to a fine of not more than one thousand dollars 8 ($1 ,000) or imprisonment for not more than ninety days, or both such fine 9 and imprisonment. 10 A. Violation. Injunction action. Any violation of the provisions of this ordinance constitutes a public nuisance which the City can abate 11 by an action in Snohomish County Superior Court. The costs of such action shall be taxed against the violator. 12 B. Civil penalty. In addition to or as an alternative to any other 13 penalty provided herein or by law any person who violates any provision of this ordinance shall be subject to a civil penalty in an amount not 14 to exceed two hundred fifty dollars per violation to be directly assessed by the Director of Weights and Measures. The Director, in a 15 reasonable manner, may vary the amount of the penalty assessed to consider the appropriateness of the penalty to the violator; the 16 gravity of the violation; the number of past and present violations committed and the good faith of the violator in attempting to achieve 17 compliance after notification of the violation. All civil penalties assessed will be enforced and collected in accordance with the 18 procedure specified herein and in accordance with the rules promulgated hereunder. 19 C. Provisions Nonexclusive. Penalty and enforcement provisions provided 20 in this article are not exclusive, and the City may pursue any remedy or relief it deems appropriate. 21 Section 36: RULES AND REGULATIONS 22 The Chief of Police, City Clerk and Weights and Measures Director are 23 authorized to promulgate rules and regulations for the operation of for-hire 24 vehicles consistent with the terms of this ordinance. 25 Section 37: TITLE - GENDER 26 A. All references in the ordinance to the City Clerk, Chief of Police and 27 Director of Weights and Measures shall include their respective designees. 28 B. Any reference to or use of the terms "he," "she," "him," "her," , or 29 other gender-based classification, if applicable as shown by the context thereof, shall apply to the opposite gender, also. 30 Section 38: CONFLICTING PROVISIONS 31 In the event any of the provisions of this ordinance conflict with any 32 21
