• <br /> Penalty for Violations <br /> Any person, firm, corporation, or association or any agent of any person, <br /> firm, corporation or association who violates any provisions of this title <br /> shall be subject to the provisions of Ordinance No. 1383-87, City of Everett <br /> Cease and Desist Order Ordinance. <br /> Public Nuisance: <br /> Any building or structure set up, erected, built, moved or maintained or any <br /> use of property contrary to the provisions of this title, shall be and the <br /> same is hereby declared to be a public nuisance. <br /> The City is hereby authorized to apply to any court of competent <br /> jurisdiction for and such court, upon hearing and for cause shown, may grant <br /> a preliminary, temporary or permanent injunction restraining any person, <br /> firm and/or corporation from violating any of the provisions of this title, <br /> and compelling compliance with the provisions thereof. <br /> Non-Exclusive Provisions: <br /> Penalty and enforcement provisions provided in this title shall not be <br /> exclusive, and the City may pursue any remedy or relief it deems appropriate. <br /> 025 <br /> Section .21: Ordinance No. 3572 as amended (Title 19 E.M.C.) is <br /> hereby amended by the addition of the following sections: <br /> CITY NONLIABILITY. <br /> A. This Ordinance is intended to provide for and promote the health, <br /> safety and welfare of the general public, and not to create or <br /> otherwise establish or designate any particular class or group of <br /> persons who will or should be especially protected or benefited by <br /> the terms of this ordinance. <br /> -29- <br />
