1 motor vehicle operator's license issued by any state <br /> bearing the applicant's photograph and date of birth; <br /> 2 or (ii ) a state issued identification card bearing <br /> the applicant's photograph and date of birth. <br /> 3 <br /> c. The City Clerk shall issue the license promptly upon <br /> 4 receipt of the application, the information required <br /> to be in the application, the investigation by the <br /> 5 Police Department in accordance with Section 1 (E)(4) , <br /> and the license fee. <br /> 6 <br /> 3. If the identity of any person or entity defined in Section <br /> 7 1 (E)(1 ) (c) changes, notice shall be provided in writing to <br /> 8 the City Clerk forthwith. The information required to be <br /> provided pursuant to this section shall be that information <br /> required pursuant to Section 1 (E) (1 )(c) of this chapter. <br /> 9 <br /> 4. The Clerk, upon presentation of such applications and <br /> 10 before acting upon the same, shall refer such applications <br /> to the Police Department, which shall make a full <br /> 11 investigation as to the truth of the statements contained <br /> therein. <br /> 12 <br /> 13 Section 4: That Section 4 of Ordinance No. 1240-86 which reads as <br /> 14 follows: <br /> 15 <br /> 16 The license application shall be approved or disapproved within <br /> ten (10) working days from the date of filing a completed <br /> 17 application which complies with the requirements of this chapter, <br /> unless the applicant agrees to an extension of the time period in <br /> 18 writing. <br /> 19 In the event that the City denies a license, the City shall <br /> within the aforesaid ten (10) day period notify the applicant of <br /> 20 the denial and the reasons therefor. The denial shall be for a <br /> period of time not to exceed one year. Should the applicant <br /> 21 disagree with the City's determination, he must file a notice of <br /> nonacceptance with the City Attorney' s Office within ten (10) <br /> 22 working days of receipt of the notification of denial . <br /> 23 The City shall , within five (5) working days following receipt of <br /> the notice of nonacceptance, apply to the Snohomish County court <br /> 24 for a judicial determination as to whether the applicant's <br /> license was properly denied. The burden of showing that the <br /> 25 applicant's license was properly denied shall rest on the City. <br /> 26 If a preliminary judicial determination sustaining the City's <br /> denial of the subject license is not obtained within five (5) <br /> 27 working days from the date the complaint is served, an interim <br /> license shall be issued under this chapter by operation of the <br /> 28 law. Said interim license shall issue in any event if a final <br /> judicial determination on the merits is not obtained within <br /> 29 twenty (20) days from the date the complaint is filed. In such <br /> case, the interim license will remain in effect until a final <br /> 30 judicial determination on the merits is reached. Provided, <br /> however, that any delays caused or requested by the applicant <br /> 31 shall be excluded from the above-mentioned twenty (20) day period. <br /> 32 <br /> 4 <br />
