• <br /> 1 be and the same is hereby amended to read as follows: <br /> 2 <br /> The license application for a public place of adult entertainment <br /> 3 license shall be approved or disapproved within five (5) working <br /> days from the date of filing a completed application which <br /> 4 complies with the requirements of this chapter, unless the <br /> applicant agrees to an extension of the time period in writing. <br /> 5 The license application for a manager's or entertainer's license <br /> shall be approved or disapproved as promptly as time and <br /> 6 conditions permit, but in no event will it exceed three (3) <br /> working days from the date of filing a completed application <br /> 7 which complies with the requirements of this chapter, unless the <br /> applicant agrees to an extension of the time period in writing. <br /> 8 Pending the approval /denial of a completed license application, <br /> the manager or entertainer will be provided a temporary permit to <br /> 9 be a manager or entertainer. Such permit shall automatically <br /> expire and become null and void upon the approval /denial of a <br /> 10 license. Any manager or entertainer issued a temporary permit <br /> shall comply with the provisions of this ordinance and such <br /> 11 permit shall be withdrawn by the City in the event the permittee <br /> violates any provisions of this ordinance. Additionally, any <br /> 12 manager or entertainer issued a temporary permit shall be subject <br /> to the penalty provisions provided in this ordinance. <br /> 13 <br /> In the event that the City denies a license, the City shall <br /> 14 within the aforesaid time period (5 days for public place of <br /> adult entertainment license, 3 days for entertainer's/managers) <br /> 15 notify the applicant of the denial and the reasons therefor. The <br /> denial shall be for a period of time not to exceed one year. <br /> 16 Should the applicant disagree with the City's determination, he <br /> must file a notice of nonacceptance with the City Attorney's <br /> 17 Office within ten (10) working days of receipt of the <br /> notification of denial . <br /> 18 <br /> The City shall , within five (5) working days following receipt of <br /> 19 the notice of nonacceptance, apply to the Snohomish County court <br /> for a judicial determination as to whether the applicant's <br /> 20 license was properly denied. The burden of showing that the <br /> applicant' s license was properly denied shall rest on the City. <br /> 21 <br /> If a preliminary judicial determination sustaining the City' s <br /> 22 denial of the subject license is not obtained within five (5) <br /> working days from the date the complaint is served, an interim <br /> 23 license shall be issued under this chapter by operation of the <br /> law. Said interim license shall issue in any event if a final <br /> 24 judicial determination on the merits is not obtained within <br /> twenty (20) days from the date the complaint is filed. In such <br /> 25 case, the interim license will remain in effect until a final <br /> 26 judicial determination on the merits is reached. Provided, <br /> however, that any delays caused or requested by the applicant <br /> shall be excluded from the above-mentioned twenty (20) day period. <br /> 27 <br /> 28 Section 5: That Section 1 (F) of Ordinance No. 1196-85 which reads as <br /> 29 follows: <br /> 30 <br /> 31 <br /> 32 <br /> 5 <br />
