I <br /> composition has fluctuated while the head of household has been <br /> homeless. <br /> This defmition is taken from 24 CFR 578.3. If this regulation is later amended or if <br /> another regulatory or statutory definition of chronic homelessness later becomes <br /> widely used, the parties agree to reasonably cooperate to amend this Covenant to <br /> update to the new definition. The Planning Director has the authority to agree to and <br /> execute such an amendment on behalf of the City. <br /> 1.2.2 Low Income. Except as otherwise provided by a Substitute <br /> Approved Management and Operations Plan approved by the City in accordance with <br /> Section 10,all residents at the time of initial occupancy have a gross annual household <br /> income at or below 50%of the local area median income,as local area median income <br /> is determined from time to time by the United States Department of Housing and <br /> Urban Development(HUD). If HUD ceases to provide estimates of median income, <br /> then median income will mean such comparable figure for Snohomish County, <br /> Washington published or reported by a federal, state, or local agency as the City shall <br /> select. <br /> 1.2.3 Prohibited Residents. Owner shall not allow as residents <br /> persons who have been criminally convicted in connection with methamphetamine <br /> production,convicted of arson or convicted of sex offenses. Owner shall not allow as <br /> residents persons who have exhibited serious or recent violent behavior. <br /> 1.3 Other Requirements <br /> 1.3.1 Number of Residential Units. Unless otherwise approved <br /> by the Planning Director in writing,the.Supportive Housing Facility must contain at <br /> least 65 residential units. Any approval by the Planning Director of a lesser number <br /> of units is at the Planning Director's sole discretion and may be withdrawn at any <br /> time. <br /> 1.3.2 Maintenance. Owner shall maintain the Supportive <br /> Housing Facility at all times in good condition and repair. <br /> 1.3.3 Demolition. Owner shall not cause or permit the <br /> demolition or removal of a substantial portion of the Supportive Housing Facility <br /> without the express written consent of the Planning Director. <br /> 4 <br /> 66 <br />
