I <br /> • <br /> 1.3.4 Hearing Examiner Decision. The Supportive Housing <br /> Facility must comply with the City Hearing Examiner's Decision regarding the <br /> Property dated June 5,2017. <br /> Section 2. Management and Operations <br /> 2.1 Approved Management and Operations Plan <br /> 2.1.1 Submission and Approval. No later than October 1,2020, <br /> and every five years thereafter, Owner shall submit to the City Planning Director for <br /> approval a management and operations plan for the Supportive Housing Facility <br /> containing at least the Minimum Elements(as defined below). Failure to submit such <br /> a plan is a breach of this Covenant. The Planning Director's approval will not be <br /> unreasonably withheld, with such reasonableness taking into account, among other <br /> things, the purpose of the Supportive Housing Facility and its impacts on the <br /> surrounding neighborhood. Upon Planning Director approval of the proposed plan, <br /> the plan is the "Approved Management and Operations Plan"for the following five <br /> years or until the approval of the next Approved Management and Operations Plan, <br /> whichever is later. <br /> 2.1.2 Covenant Controls Approved Management and Operations <br /> Plan. If an Approved Management and Operations Plan is inconsistent with this <br /> Covenant,this Covenant controls. <br /> 2.1.3 Initial Approved Management and Operations Plan. Until <br /> the approval of an Approved Management and Operations Plan under Section 2.1.1 <br /> above, the Approved Management and Operations Plan is the management plan <br /> approved by the Planning Director under EMC 19.39.155(3)on 2017. <br /> 2.2 Minimum Elements. An Approved Management and Operations Plan <br /> under Section 2.1.1 above must contain at least the following elements (each, a <br /> "Minimum Element"): <br /> 2.2.1 Admissions Policy: The plan must specifically state the <br /> policy for selecting and screening prospective residents of the Supportive Housing <br /> Facility. This must at least include: <br /> 2.2.1.1 Requirements Regarding Chronically Homeless, <br /> Low Income, and Prohibited Residents. The admissions policy must state how the <br /> Supportive Housing Facility will select residents in accordance with Section 1.2 above. <br /> With respect to Section 1.2.3 (Prohibited Residents),the admissions policy must state, <br /> 5 <br /> 67 <br />
