Ted Budden To: Kevin Fagerstrom Cc: Tony Lee Subject: FW: 3231 Broadway Mixed-Use Building W permit status Kevi n, Please find attached an analysis of the Code deficiencies and associated violations that exist within the building and group of occupancies located at 3231 Broadway Ave. I have worked with Meg Haley,Tony Lee and representatives of the Everett Fire Department to assess the conditions present here and to evaluate the extent and nature of the code violations. It is our determination that this building is Unsafe as defined by IPMC section 108.1.1.This structure is being operated and occupied contrary to law, IPMC sections 106.1 and 108.4 The owner has made some efforts to resolve the code concerns over the last several months as mentioned in the summary attached. These efforts unfortunately have fallen significantly short ofthe immediate need. It is our position that the code violations present within this building be abated immediately. Failure to address the violations in a timely manner should cause condemnation to occur of the affected areas of the building. Please initiate enforcement action as your schedule allows. Based on review of the BW1410-052 10/30/14 permit plans, the building does not provide minimum safeguards to protect or warn occupants in the event of f�re, per the 2012 International Property Maintenance Code fIPMC), Section 108.1.1 Unsafe Structures. � Egress Fhvtas.pd# 1. IPMC 702.1 'Means of Egress' requirements are not met for the second floor residences (6000 square feet). a. The fire escape is in disrepair and does not provide direct access to grade. b. A posted sign indicates the fire escape is a second exit, but it does not have an illuminated exit sign or emergency lighting. c.
