11 4 1 ORDINANCE NO. a47-17 2 AN ORDINANCE amending the exemption section of the Massage 3 Parlor Licensing Ordinance, Chapter 24, Section 2 of Ordinance No. 295-74 (Everett Municipal Code 5.96 .020 ) . 4 5 THE CITY OF EVERETT DOES ORDAIN: 6 Section 1: Chapter 24 , Section 2 of Ordinance No. 295-74 7 (E.M.C. 5 .96 .020 ) which reads as follows: 8 9 Exemptions. 10 A. The provisions of this title do not apply to: 11 1. Persons giving massage treatments or baths in a private residence or a nonprofit bona fide charitable 12 private social or athletic club not open to the public generally; 13 2 . Athletic coaches or trainers affiliated with public or private educational institutions or athletic 14 organizations; 3. Students enrolled in schools of massage performing 15 such practices of massage as are incidental to their course of study. 16 B. The provisions of this title shall not apply to massage 17 treatments given in any hospital, duly licensed nursing or convalescent home, or by physical therapists duly licensed, 18 who treat patients only upon written prescription of a licensed doctor of medicine, or by any other person 19 licensed by the state to treat the sick, injured or infirm, or by any nurse under the direction of a person so licensed. 20 C. Licensed beauty operators and barbers who perform only such 21 acts of massage as are customarily given in beauty salons and barber shops for purposes of beautification only are 22 also exempt from the provisions of this title. 23 is hereby amended to read as follows: 24 25 Exemptions. 26 A. Persons giving massage treatments in their private residence to members of their immediate family; 28 persons giving massage treatments as part of a non-profit research program; or persons giving 29 massage treatments in a bona fide non-profit charitable private social club or a bona fide 30 athletic club not open to the public generally; 31 32
