11 4 <br /> 1 ORDINANCE NO. a47-17 <br /> 2 AN ORDINANCE amending the exemption section of the Massage <br /> 3 Parlor Licensing Ordinance, Chapter 24, Section 2 of Ordinance <br /> No. 295-74 (Everett Municipal Code 5.96 .020 ) . <br /> 4 <br /> 5 THE CITY OF EVERETT DOES ORDAIN: <br /> 6 Section 1: Chapter 24 , Section 2 of Ordinance No. 295-74 <br /> 7 (E.M.C. 5 .96 .020 ) which reads as follows: <br /> 8 <br /> 9 Exemptions. <br /> 10 A. The provisions of this title do not apply to: <br /> 11 1. Persons giving massage treatments or baths in a <br /> private residence or a nonprofit bona fide charitable <br /> 12 private social or athletic club not open to the <br /> public generally; <br /> 13 2 . Athletic coaches or trainers affiliated with public <br /> or private educational institutions or athletic <br /> 14 organizations; <br /> 3. Students enrolled in schools of massage performing <br /> 15 such practices of massage as are incidental to their <br /> course of study. <br /> 16 B. The provisions of this title shall not apply to massage <br /> 17 treatments given in any hospital, duly licensed nursing or <br /> convalescent home, or by physical therapists duly licensed, <br /> 18 who treat patients only upon written prescription of a <br /> licensed doctor of medicine, or by any other person <br /> 19 licensed by the state to treat the sick, injured or infirm, <br /> or by any nurse under the direction of a person so licensed. <br /> 20 C. Licensed beauty operators and barbers who perform only such <br /> 21 acts of massage as are customarily given in beauty salons <br /> and barber shops for purposes of beautification only are <br /> 22 also exempt from the provisions of this title. <br /> 23 is hereby amended to read as follows: <br /> 24 <br /> 25 Exemptions. <br /> 26 A. The provisions of this title do not apply to: <br /> 27 1. Persons giving massage treatments in their private <br /> residence to members of their immediate family; <br /> 28 persons giving massage treatments as part of a <br /> non-profit research program; or persons giving <br /> 29 massage treatments in a bona fide non-profit <br /> charitable private social club or a bona fide <br /> 30 athletic club not open to the public generally; <br /> 31 <br /> 32 <br />
